Stays and Urgent Hearings: Questions and Answers
35 questions on this subject, answered simply by the team of Advocate B.K. Singh. Other subjects are listed alongside, and the main FAQ page lets you search across all 636 questions.
Answers for employees, retirees and candidates who need the tribunal to act quickly: a relieving order fixed for Monday, a recovery starting this month, a reversion or an appointment about to be cancelled. The questions cover interim relief under Section 24, urgent mentioning, what a stay does and does not cover, and what to do when the office ignores it or the stay is later vacated. Advocate B.K. Singh adds what he looks for before pressing for an urgent order.
My transfer order came yesterday and the relieving date is next Monday. What should I do first?
Move this week, not after you are relieved. Give a short representation to the authority that passed the order and keep the dated receipt. At the same time get your papers to a lawyer: the transfer order, the policy or guidelines you say were broken, and proof of the hardship. An OA with a prayer for interim relief can then be filed and mentioned before the relieving date. Once you are relieved and have joined, the tribunal is far less willing to reverse the move. See what changes after relieving.
Does filing an OA by itself stop the department's order?
No. Filing an Original Application does not freeze anything. The order you are challenging stays fully in force until the tribunal passes an interim order saying otherwise. Many employees assume that a diary number from the registry protects them, stop attending office or refuse to hand over charge, and then face a fresh charge of disobedience. Until you have a written order of the bench, keep obeying the department's order and keep a record that you are doing so under protest.
What does CAT need to see before it grants a stay?
Three things, broadly. First, a prima facie case: a serious legal question, not just unfairness. Second, the balance of convenience: who suffers more if the order runs till the final hearing. Third, harm that money cannot later undo, such as a family uprooted mid year or pension cut for an old retiree. A strong case with no urgency often gets an early hearing date instead of a stay. The three tests for a stay are explained with examples.
Is there a rule on when CAT can pass an interim order before hearing the department?
Yes, Section 24 of the Administrative Tribunals Act. Normally the department must first get a copy of the application and the documents, and a chance to be heard. The tribunal can skip that step only if it records reasons why an order is needed at once to prevent harm. Such an order passed without hearing the other side lapses after 14 days unless the department has been served and the tribunal confirms it.
CAT stayed my relieving without hearing the department. Is the stay safe now?
Not yet. Such an order lasts only 14 days unless the department is served and the bench confirms it. So make sure the standing counsel and your office actually receive the OA and the order, and keep proof. On the next date the department will argue for vacating it. Treat the first order as breathing time to put your full case on record, not as the end of the matter.
What is urgent mentioning and who is allowed to do it?
Urgent mentioning means asking the bench to list a fresh case out of turn because waiting for the normal listing would make it useless, for example a relieving fixed for tomorrow. Your advocate, or you if appearing in person, mentions it before the bench at the start of the day or through the registry's urgent listing process. Benches differ in their practice, and a CAT circular of October 2026 was reported to allow online mentioning, so check with your registry. Read how urgent mentioning works.
Should I send a copy of my OA to the department before the urgent hearing?
Yes. Serving an advance copy on the department's standing counsel before the first hearing helps you. The bench is more willing to pass an interim order when the government side is present and cannot later say it was taken by surprise. Send it by email and by hand or speed post, and file the proof with your OA. Skipping service to keep the department in the dark usually backfires with the bench.
Do I have to obey the transfer order while my stay application is still pending?
Yes, in most cases. Until the bench actually stays the order, it binds you. If the office relieves you, hand over charge in writing and record that you are complying under protest because your OA is pending. Refusing to move or proceeding on unsanctioned leave can lead to a charge of unauthorised absence, and that becomes a fresh problem the tribunal may not help with. Comply, protest in writing, and press for an early hearing.
Will CAT stay my transfer because my child is in Class 12 this year?
On that ground alone, probably not. Courts treat transfer as part of service, and since Shilpi Bose (1991) and S.L. Abbas (1993) they interfere only where the order breaks a statutory rule, is mala fide, or is passed by an authority with no power to pass it. Transfer guidelines are not enforceable rights in themselves. A child's board exam carries weight when the department's own policy protects such cases and has been ignored, so find and attach that policy.
My office relieved me while I was on sanctioned leave. Can the tribunal still stop the transfer?
It can, but you must act quickly and explain the timeline clearly. Relieving someone in absentia is allowed in some situations, so the question is whether it was done to defeat a pending representation or a hearing. Attach the leave sanction, the relieving order and the date you learnt of it. If you have not yet joined the new station, ask in the OA for status quo ante, which means putting you back where you were. Delay of even a few weeks weakens this.
The department has only issued a show cause notice for recovery of excess pay. Is it too early to seek a stay?
Usually yes. A show cause notice is not yet a decision, and the tribunal expects you to reply first. Use the reply well: state your group (A, B or C), how many years ago the excess was paid, whether you gave any undertaking, and why recovery now would be harsh. If a recovery order then follows, you have a proper order to challenge and a clear record. Going to CAT against a mere notice usually ends with a direction to reply. See recovery stay cases.
I have been reverted from an ad hoc promotion. Can CAT keep me on the higher post in the meantime?
Sometimes. Ad hoc promotion gives no right to the post, so a stay is hard where a regularly selected person is waiting to join. Interim protection is more likely where you have held the post for years, no regular appointee is ready, and the reversion came without notice or looks like punishment. Often the tribunal does not stay the reversion but directs that it will be subject to the outcome of the OA, and that any recovery of the higher pay already drawn waits.
Can CAT stop a DPC from meeting, or stop my junior from being promoted, until my case is decided?
It rarely stops a DPC entirely, because that would hold up everyone else's promotion. The usual interim order is narrower: the DPC may proceed, but any promotion given will be subject to the result of your OA, or one post is to be kept vacant for you. Ask for exactly that in your OA. An order keeping one vacancy unfilled is often more useful than a blanket stay you are unlikely to get.
What does 'subject to the outcome of the OA' mean in an interim order?
It means the department may go ahead, but whatever it does can be undone if you win. A promotion, posting or appointment made under such an order carries no settled right for the person who gets it. This protects you without stopping the system. Keep a copy of the order with your service papers, and if the department later argues that the promoted person has gained a vested right, that line in the interim order answers it.
The interim order says 'no coercive steps'. What exactly does that cover?
It stops the department from enforcing the order against you by force, such as deducting money, relieving you, evicting you or passing a penalty, until the tribunal says otherwise. It does not cancel the order or stop the department from continuing paperwork, filing its reply or holding an inquiry unless the order says so. Read the exact words, because the scope depends on them. If the office seems to be stretching or narrowing it, ask your advocate to seek a clarification on the next date.
Can the departmental inquiry be paused while my criminal case on the same facts is pending?
Only in limited cases. Both can run side by side as a rule. In Capt. M. Paul Anthony (1999) the Supreme Court said the inquiry may be kept on hold where the criminal charge is grave, the facts are the same, and the case involves complicated questions of fact and law, but not indefinitely. If the trial is dragging, the department can resume. When asking for this, show the overlap clearly: same witnesses, same documents and same allegation.
Will CAT stay my suspension order?
Not usually. Suspension is not a penalty, and the tribunal rarely interferes at the interim stage. What it does look at closely is whether the suspension was reviewed within 90 days under Rule 10 of the CCS (CCA) Rules, and whether a chargesheet came within three months as required by Ajay Kumar Choudhary (2015). Where those steps were missed, the more practical relief is a direction to review or revoke, rather than a stay. See suspension cases.
I was retired early under FR 56(j). Can CAT keep me in service till the case is decided?
Rarely at the interim stage. Premature retirement in public interest is not a punishment and courts give the department room on it, so an interim order putting you back on duty is uncommon. The tribunal is more likely to hear the OA early, especially if your record is clean, the review committee did not look at your recent APARs, or the order came soon after a promotion. Get the review committee minutes through the OA or RTI to test this.
My date of birth correction is pending and I retire next month. Can CAT keep me in service?
Very unlikely by an interim order. Tribunals avoid letting someone continue past the recorded date of superannuation on the strength of a disputed date of birth, because if the claim fails, the extra service cannot be undone cleanly. Courts are also wary of late birth date claims made near retirement. The more realistic request is an early hearing, and a direction that if you succeed you get the benefit of the period you were kept out. Go to the tribunal well before the last month.
My selection was cancelled after police verification, before I could join. Is interim relief possible?
Sometimes. CAT may direct that a post be kept vacant, or that your case be considered afresh, while the OA is heard. It almost never orders joining at the interim stage when the issue is concealment or a pending criminal case. Your chances improve if you disclosed everything in the attestation form, or the case had already ended in acquittal. Bring the attestation form, the FIR and judgment, and the cancellation letter to the first meeting.
Can CAT allow me to appear in an interview or exam provisionally while my eligibility dispute is pending?
Yes, this is a fairly common interim order. Where the dispute is about age, a certificate, or a qualification, the tribunal may let you appear provisionally so that the chance is not lost, with the result kept in a sealed cover or declared subject to the OA. It gives you no right to appointment if you lose the case. Apply before the exam or interview date, and attach the admit card or call letter, the rejection message and the advertisement clause.
Can CAT stay a recruitment result or the joining of selected candidates?
It can, but it seldom stops the whole process. Halting a result affects hundreds of candidates who are not before the tribunal, so the usual order is that appointments will be subject to the outcome, or a number of posts will be kept unfilled. If you want selected candidates bound by the result, at least some of them should be made parties, sometimes in a representative capacity. Courts move faster when the challenge is filed before appointment letters go out.
Can I get interim relief giving me something new, like a promotion, rather than stopping an order?
That is much harder. A stay keeps things as they are. An interim order granting a benefit you never had, like promotion, a higher pay level or regularisation, would give you the final relief before the case is decided, and tribunals avoid that. They may direct the department to consider your case, or keep a post free. The real remedy for a positive benefit is usually an early final hearing, so ask for that with the OA.
My OA was filed late with a delay application. Can I still get a stay?
Possibly, but the delay comes first. If the delay is long, many benches first decide whether to condone it and will not pass an interim order on a case that may be thrown out for limitation. Where the action is fresh, such as a recovery that started this month on an old decision, the bench may still give interim protection. Explain the delay day by day in the condonation application. Advocate B.K. Singh usually checks whether the present action is a fresh cause before relying on condonation.
How does Advocate B.K. Singh decide whether to press for an urgent stay?
He first asks what will actually happen to the client if nothing is done for six weeks. If the answer is a move to another state next week, a pension cut from this month, or loss of an interview date, urgent listing is worth asking for. If the harm can be fully corrected later with arrears, he usually advises a well drafted OA and a request for early hearing instead. Pressing urgency without real harm can cost credibility with the bench.
The department says it never received the stay order. What should I do?
Serve it again, properly, and keep proof. Send the order by email to the officer concerned and the head of office, and give a copy by hand to the section against a receiving stamp. Also send it to the department's standing counsel. Many CAT orders are uploaded online the same day, but do not rely on the office finding it. A claim of no knowledge becomes weak once you hold a dated receipt.
Can CAT undo a relieving or a deduction made after the stay was passed?
Yes. If the department acted after it knew of the stay, the tribunal can direct that the earlier position be restored: you are taken back at the old station, or the amount deducted is refunded. This is called status quo ante. Move an application quickly with the stay order, proof of service, and the relieving or salary slip showing the action. The tribunal may also issue notice to the officer to explain why contempt proceedings should not start.
Can the officer who ignored my stay order be personally punished?
Yes. Section 17 of the Administrative Tribunals Act gives CAT the same power as a High Court to punish for contempt of its orders. The officer who deliberately disobeyed can be called to explain and, in serious cases, punished. In practice, most officers comply once a contempt notice issues, and the tribunal's main aim is compliance rather than punishment. Keep a dated record of what you served and what the office did after that. For the full process see contempt and execution.
The department transferred me to a third place after CAT stayed my first transfer. Is that allowed?
A fresh order is a new decision, so the stay on the first order does not automatically cover it. But if the new order is simply a way to get around the stay, the tribunal takes a dim view of it. Bring it to the bench's notice through an application in the same OA, pointing out the timing and the reasons given, if any. The bench may stay the new order too, or treat it as an attempt to defeat its order.
The tribunal refused my stay. Does that mean I will lose the OA?
No. Refusing interim relief is only a view that you have not shown enough urgency or harm for the tribunal to act before the hearing. Many OAs are allowed after a stay was refused, especially in pay, promotion and pension cases where arrears can be paid later. Use the time to strengthen the record: file a sharp rejoinder and collect the documents. Ask the bench for an early date for final hearing.
My stay is under attack: the department wants it vacated. How do I defend it?
The bench will hear both sides on whether the stay should continue. The department usually argues that the order was passed without its version, that the post is needed, or that public interest suffers. File a short reply to the vacation application with any documents that answer those points, rather than repeating the OA. Attend the date personally or make sure your advocate does, because an unopposed vacation application is usually allowed.
My stay was vacated. Will the department recover everything it held back in one go?
It can resume what the stay had stopped, but not in any manner it likes. If recovery resumes, ask in writing for reasonable instalments and remind the office of the Rafiq Masih exceptions if you are Group C or retired. If your relieving had been put off by the stay, expect a fresh relieving order and little time to join. Read the vacation order: sometimes the bench vacates the stay but protects part of what you got.
My interim order says 'till the next date'. What if the next date is adjourned?
Check the order sheet of every date. An interim order expressed to run till the next date of hearing may need to be extended on each date, and if the case is adjourned without a fresh line extending it, the department may treat it as lapsed. Most benches extend it routinely, but it does get missed. If the case is adjourned in your absence, read the order online that evening and ask your advocate to mention it if the extension was left out.
If I lose the OA later, is everything I got under the stay taken back?
Generally yes. An interim order is temporary and merges into the final result. If you stayed at a station, you will be moved. If recovery was stopped, it can resume. If you drew pay for a higher post under an interim order, the department may try to recover the difference, though the Rafiq Masih limits still matter. Weigh this before asking for interim money benefits. Advocate B.K. Singh often tells clients to keep such amounts aside until the case ends.
Can a stay be granted for everyone in a group OA, or only for those who need it urgently?
The bench can pass interim orders for all applicants or only some. Where the applicants are in the same position, say twenty Group C staff facing the same recovery order, a common interim order is normal. Where only a few face immediate harm, the bench may protect them alone. In a joint OA, state each applicant's own urgency, such as retirement dates or relieving dates. For help with a joint case, contact Advocate B.K. Singh with each person's order.
