Service cases of central government employees, before CAT and beyond

A suspension with no end date, a promotion that went to a junior, money being cut from your pension, a selection cancelled after document verification. We take service disputes from the first representation to the Central Administrative Tribunal, the High Court and, when it is needed, the Supreme Court.

We appear before the Principal Bench of CAT in New Delhi, the Delhi High Court and the Supreme Court, and work with associate counsel at tribunal benches across India. This is a private law firm website, not the tribunal's official site.

Advocate Sadhna Singh and Advocate B.K. Singh

Meet Advocate B.K. Singh

Advocate B.K. Singh founded B.K. Singh & Associates and has practised for more than twenty years before the Supreme Court, the Delhi High Court and other High Courts, the Central Administrative Tribunal and other tribunals. He holds MCA, LL.B. and LL.M. degrees.

His first question on a service file is about the department's own paper trail: the service book, the APAR folder, the DPC minutes, the noting behind the order. A case is usually decided by what that record shows and by whether it reached the tribunal in time.

How a service case usually moves

A tribunal order helps only when the department acts on it, so the plan is made with the end in view.

  1. Reading the record

The order, service book and APARs are checked against the rule relied on, and the limitation date is fixed first.

  2. Representation and RTI

Section 20 usually means a representation and a wait of up to six months. RTI is used to get the DPC minutes and file notings.

  3. Original Application

The OA goes to the bench for your place of posting, with every document relied on and a stay application where needed.

  4. Reply and hearing

The department replies, a rejoinder answers it, and the bench hears the case. Pay and pension cases often move faster.

  5. Order and compliance

Either side may go to the High Court. If the department sits on the order, contempt or execution follows.

Frequently asked questions

Do I have to approach my department before going to the tribunal?

Usually yes. Section 20 of the Administrative Tribunals Act expects you to use the departmental remedy first, such as a representation or an appeal, and wait up to six months for a decision. Where harm is about to happen, for example a transfer being carried out or a recovery starting this month, the tribunal can be approached at once with a request for interim relief.

How much time do I have to file a case before CAT?

One year from the final order under Section 21. If you made a representation and six months passed with no decision, the year is counted from the end of those six months. A late case is not closed for good: it needs a separate application explaining the delay, and the reasons have to be real.

Can the tribunal stop a recovery from my salary or pension?

Yes, it can stay a recovery while the case is pending. For Group C staff, pensioners and money paid more than five years before the recovery order, the Supreme Court has held that recovery is often not allowed at all, unless you gave a written undertaking when the pay was fixed.

I work in a PSU, a bank or a CAPF. Is CAT my forum?

Generally not. Staff of most public sector undertakings and banks, and personnel of the CRPF, BSF, CISF, ITBP and SSB, file a writ in the High Court. Members of the Army, Navy and Air Force go to the Armed Forces Tribunal. CAT covers central government staff and bodies notified under Section 14(2).

Is this the official website of the Central Administrative Tribunal?

No. This is the website of B.K. Singh & Associates, a private firm of advocates. For official case status, cause lists and e-filing, use the tribunal's own website.
