OPS option order of 3 March 2023 (OM 57/05/2021-P&PW(B)); CCS (Pension) Rules, 2021; Administrative Tribunals Act, 1985, Sections 19 to 21

Recruited Against a Pre-2004 Vacancy but Put in NPS

Joined after 1 January 2004 against a post advertised before 22 December 2003? How the OPS option works, why claims are refused and how to challenge it.

In short. Selected for a post that was put out for recruitment by 22 December 2003, but joined only in 2004 or later and placed in NPS? A DoPPW order dated 3 March 2023 gave people like you one chance to shift to the old pension under the CCS (Pension) Rules. The option window closed on 31 August 2023, but refusals, missed options and orders never carried out are still being contested. Expect a few months for the department to answer a representation and one to three years if the tribunal has to decide. Your first job is to find the original advertisement and any rejection letter.

Is this your situation?

  • Your recruitment notice is dated 2003 or earlier, yet you reported for duty in 2004 or later and were given a PRAN.
  • You applied for the old pension under the 3 March 2023 order and the appointing authority said no.
  • Nobody in your office told you about the option, and 31 August 2023 came and went.
  • Your option was accepted, yet your salary slip still shows NPS deductions and no GPF account has been opened.
  • You have already retired on NPS, or a family member died in service, and you believe the post was advertised before 2004.
  • You got a compassionate appointment after 2003, though your application went in during 2003 or earlier.
  • Colleagues from the same recruitment batch got the old pension and you did not.

The date that decides your claim is the advertisement date, not the joining date

The National Pension System was notified on 22 December 2003 and applies to central government recruits joining on or after 1 January 2004. Many people who took an exam or interview in 2003 joined months or even years later because of slow police verification, medical boards, court cases over the select list, or plain administrative delay. Their posts were advertised under the old regime, yet they landed in NPS.

A DoPPW memorandum issued on 3 March 2023 was written for exactly these people. Its test is whether the vacancy you filled had been put out for recruitment (by advertisement or notification) no later than 22 December 2003. If it had, you were allowed a single chance to switch to the pre-NPS pension, which today means the CCS (Pension) Rules, 2021. The date your appointment letter was issued and the date you reported for duty do not decide eligibility. What decides it is when the recruitment for that vacancy was put out.

So the honest first question is not 'when did I join' but 'which notice was I recruited under, and when was it published'. People lose good claims because they cannot produce that notice, and some pursue hopeless ones because they assume a 2003 exam date is enough when the vacancy was in fact notified again in 2004.

The orders and rules your case will turn on

DoPPW OM dated 3 March 2023

This is the main order. It let central civil staff who entered service from 2004 onwards, but against vacancies put out for recruitment by 22 December 2003, choose the old pension once. The last date for giving the option was 31 August 2023. Each case was then to be checked and decided by the appointing authority, after which the NPS account of an eligible employee was to be shut. Those who were eligible but did not opt stay in NPS. An option once exercised is final.

DoPPW OM of February 2020

A narrower order from 2020 looked at the result date: if the selection result was out before 2004 and you joined later, that order applied. If your result came out in 2003, check whether you were already dealt with under this order before relying on the 2023 one.

DoPPW clarification of October 2023 on retired employees

Clarified that the 3 March 2023 order is not barred for someone who has already retired, if otherwise eligible. Because a retiree has already drawn NPS benefits, the government contribution and returns on it have to be refunded with interest before old pension benefits can be given.

CCS (Pension) Rules, 2021 and CCS (Implementation of NPS) Rules, 2021

The 2021 Pension Rules replaced the 1972 Rules and govern old pension for those covered. The NPS Implementation Rules govern everyone else, including the death and invalidity cover they give to NPS members. Your claim is really a claim to move from the second set of rules to the first.

DoPPW order of 22 June 2026 on compassionate appointees

Opens the same door to people appointed on compassionate grounds, if they applied by the last day of 2003 and were appointed only afterwards. Read the order itself for the conditions, as departments are still issuing their own implementing instructions.

Who is inside the 2023 order, and who usually falls outside it

  • Direct recruits through SSC, UPSC, RRBs and departmental recruitment. Covered if the examination or vacancy notice was published on or before 22 December 2003. A candidate from an SSC examination notified in 2003 who joined in 2005 is the classic case.
  • Civil services and other Group A entrants. An officer from an examination notified in 2002 or 2003 who joined training in 2004 can fall within the order, even though the final result came in 2004.
  • Re-advertised or carried-forward vacancies. If the original notice was withdrawn and the vacancy was advertised afresh after 22 December 2003, the department will treat you as a post-2003 recruit. You then need to show the later notice was only a continuation of the first, which is a factual fight.
  • Promotion and limited departmental exams. The order is about recruitment to a post. Someone already in service on the old pension who moves by promotion keeps the old pension anyway; someone who first entered government through a post-2003 notice cannot use a promotion date to get in.
  • Employees who moved from one central job to another. If you were on the old pension in an earlier central government post and joined a new central post after 2003 through proper channel with technical resignation, you generally keep the old pension under separate instructions. That is a different claim from the advertisement-date route.
  • Armed forces, CAPF, PSU and state government staff. The 2023 order is for central civil employees. Members of the armed forces were never in NPS. CAPF personnel have pursued their own old pension claims in the High Courts. PSU, bank and state government employees depend on their own employer's scheme.

Why appointing authorities turn down OPS claims

Most rejection letters we see are two or three lines long and say only that the applicant is 'not covered'. Behind that phrase there is usually one of a handful of reasons, and knowing which one applies tells you what evidence to chase.

The commonest is that the department cannot find the 2003 advertisement in its own records and puts the burden on you. The second is that it treats a later notice (a corrigendum, an addendum increasing vacancies, or a fresh notice after an earlier one was cancelled) as the real date of recruitment. The third is that the vacancy you filled was a different one from those advertised, for instance where the select list was operated beyond the notified number and you were adjusted against a vacancy that arose in 2004.

Other refusals rest on the deadline (the option reached the office after 31 August 2023), on the form (the option was not in the prescribed format or was not forwarded by the controlling office), or on a misreading of the order, such as insisting that the result must also have come before 2004. That last condition belonged to the February 2020 order, not the 2023 one, and an authority that applies it to a 2023 claim has misdirected itself.

Read your rejection order against this list before you reply. A representation that answers the actual reason gets a better hearing than one that simply repeats 'I am eligible'.

A Junior Engineer whose 2003 notice went missing

Here's a made-up example. A Junior Engineer in a CPWD division in Guwahati had applied under a recruitment notice published in October 2003. The written test was held in 2004, the result came late that year and, after a long wait for police verification, he joined in March 2005. In August 2023 he submitted his option. The division rejected it in January 2024, saying the 'recruitment year' in the file was 2004-05.

His own copy of the advertisement had been lost when he shifted houses. He got a copy of the Employment News issue through a public library and filed an RTI application with the recruiting agency for the notice number and the vacancy year. The reply confirmed the October 2003 notice and showed the vacancies were those reported in 2003. With these two papers his representation went to the appointing authority, which recalled the rejection and placed his case before the accounts office for closing the NPS account.

Not every case turns out this way. If the RTI reply had shown that the 2004 test was held under a fresh notice, the claim would have been weak and the honest advice would have been to stay in NPS or look at the Unified Pension Scheme.

You missed the 31 August 2023 date: is the door closed?

Officially, yes. The order says eligible employees who do not opt by the cut-off date continue in NPS. There is no general reopening of the window as of October 2026.

In practice the answer depends on why you missed it. If your office never circulated the order, if you were on deputation, long medical leave or posted at a remote station where the order did not reach you, or if you gave an option on time but the office lost it, you have something to work with. Tribunals look at whether the employee was given a fair chance to exercise a beneficial option. Where the fault lies with the department, directions to consider a late option have been given in individual cases. Where the employee simply did not act, the cut-off date is usually upheld.

Collect proof of how and when the order reached your office: a circular number, an email, a list of employees to whom it was sent. If your name is missing from that list, that is your strongest point.

Option accepted, but you are still in NPS

A large number of employees were found eligible on paper and then nothing happened. The NPS account is not closed, Tier I deductions continue, no GPF number is allotted, and the pay slip looks exactly as before. This is not a fresh dispute about eligibility. It is a failure to carry out a decision already taken in your favour.

Send your head of office a letter enclosing the acceptance order, and list three things you want done: shut the PRAN, allot a GPF number, and adjust the contributions already deducted. Give it a quarter. If the file still sleeps, an OA seeking a time-bound direction to implement is a short, narrow case. Our guide on what to do when the OPS option was exercised but you are still in NPS covers the paperwork in more detail.

Already retired on NPS, or the employee has died

Retirement does not by itself end the claim. The October 2023 clarification says the March 2023 order is not barred for those who have retired, provided they are otherwise eligible. The price is that the government contribution and returns earned on it, already paid out to you through NPS, must be refunded with interest. Before you push the claim, sit down with the figures. For someone who retired with a modest corpus and many years of life expectancy, the old pension with dearness relief usually works out far better. For someone who withdrew and spent the lump sum, the refund itself can be the hard part.

Where the employee died in service, the family's position depends on whether an option was given in time and on the separate rules that already let families of NPS members choose family pension under the old rules in death cases. Our guide on death in service under NPS explains that route, which is often simpler than an OPS claim.

Papers that prove a pre-2004 vacancy

Proof of the recruitment notice

  • The advertisement or examination notice, with its date and number (Employment News, newspaper, or the recruiting agency's notice)
  • Any corrigendum or addendum, so the department cannot argue a later date without you seeing it first
  • RTI reply from the recruiting agency or department confirming the notice date and the vacancy year
  • Requisition sent by your department to SSC, UPSC or the RRB, if you can get it

Proof of your selection and joining

  • Admit card, result notice and your position in the select list
  • Offer of appointment and appointment order
  • Joining report and the first page of your service book
  • Letters explaining delay in joining (verification, medical, court stay on the select list)

Proof of the option and the decision

  • Your option form and the forwarding letter or diary number
  • The rejection order, or proof that no decision has been taken
  • Orders granting old pension to batchmates, if you can obtain them
  • NPS statement (PRAN) and recent salary slips

From refusal to a tribunal order: the order of work

This is the sequence we usually follow. Skipping the second step is the most common reason a case stalls later.

  1. Fix the facts in writing

Prepare a one-page note: notice number and date, examination dates, result date, joining date, date of option, date of rejection. Every later document will be checked against this page, so get it right once.

  2. Get the missing proof

If the advertisement is not in your hands, file RTI applications with the recruiting agency and your department at the same time. Ask specific questions: the notice number under which you were selected and the year of the vacancies it covered.

  3. Send a reasoned representation

Send it through your controlling officer to the authority that appoints to your post, enclose the proof, and deal head-on with the reason given for refusal. The tribunal normally wants to see that the department had a fair chance to correct itself first; our page on writing the representation Section 20 expects explains the format.

  4. Wait, but not too long

Give the authority a fair period. If there is no reply in six months, or the reply is another bare refusal, you can approach the Central Administrative Tribunal. Note the dates carefully because limitation runs from them.

  5. File the Original Application

The OA under Section 19 sets out the facts, attaches the papers and asks for specific relief: quashing of the rejection, a direction to treat you as covered by the CCS (Pension) Rules, 2021, and closure of the NPS account within a fixed time. See preparing and filing an OA under Section 19.

  6. Follow through after the order

If you succeed, send a certified copy of the order with a covering letter to the department and the accounts office. Implementation involves several offices, and someone has to keep track until the GPF account appears on your slip.

How long it takes and what it costs

StageTypical timeCosts to expect
Collecting the advertisement and RTI replies1 to 3 monthsRTI fee of Rs 10 per application; photocopy and postage charges
Representation to the appointing authority2 to 6 months for a decision; the Act lets you go to the tribunal after 6 months of silenceNominal
Filing the OA before a CAT bench2 to 6 weeks to prepare and fileTribunal fee is nominal (Rs 50 under Rule 7 of the CAT (Procedure) Rules; confirm the present amount and how to pay it at the registry). Add photocopying, notary and paper book expenses
Department's reply and your rejoinder3 to 9 months, often with adjournmentsNo further tribunal fee for ordinary hearings
Final hearing and order1 to 3 years from filing, depending on the benchCertified copy charges
Implementation (closing NPS, opening GPF, refund adjustments)3 to 12 months after the orderContempt or execution steps only if the order is ignored

Which bench hears your case, and when the tribunal is not the right place

The usual rule is simple: file at the bench that covers your present place of posting, or the place where the rejection was issued. Retirees may usually choose the bench for the town they have settled in. A Postal Assistant in Indore would file in Jabalpur, a CPWD engineer in Meerut at Allahabad, and staff of ministries and attached offices in Delhi at the Principal Bench on Copernicus Marg.

The tribunal hears these cases for central government civil employees and for staff of organisations notified under Section 14(2) of the Act. If you work in an autonomous body, check whether it is notified at all; our guide on finding out if your organisation is notified shows how. If it is not, your remedy is a writ petition in the High Court.

A constable or inspector in the CRPF, BSF, CISF, ITBP or SSB cannot file in the tribunal at all. Old pension for the paramilitary forces has been litigated in the High Courts, where a 2023 Delhi High Court judgment for the personnel was taken in appeal by the Union, so find out where that stands today. The page on why the tribunal is not the forum for CAPF and the armed forces explains the right route. Bank and PSU staff file writs in the High Court. A state government teacher or clerk depends on the state's own pension policy and goes to the state tribunal, if the state has one, or else to the High Court.

Railway, postal, defence civilian and Group A staff: what differs

On the railways, the Railway Board issued matching instructions after March 2023, and pension itself now comes under the Railway Services (Pension) Rules, 2026 notified in January 2026. For a railway claimant the key paper is the 2003 RRB employment notice, and the personnel branch of the zone decides. A trackman in Secunderabad division, for instance, would file before the Hyderabad Bench. See our page for railway staff and their tribunal cases.

In the Department of Posts, many recruits of 2003-04 came through circle-level notices for Postal Assistants and Sorting Assistants. The circle office's notice date is the one to find, not the date of the aptitude test. Gramin Dak Sevaks are a separate category and are not covered by the CCS (Pension) Rules at all, so this route does not help them until they are regularly appointed to a departmental post.

Defence civilian employees (MES, ordnance establishments before corporatisation, depots and workshops) had their options routed through the PCDA concerned, which forwarded the March 2023 order with its own format. If your option went to the unit and never reached the PCDA, ask for the forwarding letter.

Group A officers recruited through a 2002 or 2003 examination notice often joined training in 2004 and were put in NPS. Their claim is usually clean on dates, and the main delay is the cadre controlling authority taking a decision for a whole batch at once.

Money: what happens to your NPS corpus, GPF and arrears

After an order bringing you under the old rules, your PRAN is wound up. Roughly speaking, what you put in (with the growth on it) is shifted into a newly opened GPF account, while the employer's contribution is taken back by the government. Ask the accounts office for a written statement of the adjustment; mistakes in this step are common and are easier to fix early. If the government share or your own contributions were never properly credited in NPS in the first place, that problem needs to be sorted out separately, as explained on our page about government share missing from your NPS account.

For a serving employee, the change mostly matters at retirement: pension at 50 percent of last pay with dearness relief, family pension, and retirement gratuity under the old rules. For someone already retired, it means a fresh pension calculation, a refund of the government contribution with interest, and then monthly pension. Arrears of pension, where a court orders them, are often limited to about three years before filing on the principle in Union of India v. Tarsem Singh (2008), so delay costs real money.

If you chose the Unified Pension Scheme before its window closed on 30 November 2025, that choice does not stop a valid OPS claim, but it does mean two sets of accounts to unwind. Our page on Unified Pension Scheme option disputes deals with the UPS side.

Limitation: a rejection letter starts a clock

Treat the rejection order as the start of a twelve-month countdown. That is the period Section 21 of the Act allows for an OA. Where your representation simply sat unanswered, the twelve months begin once six months of silence have passed. Writing again and again on the same grievance buys no extra time: in S.S. Rathore v. State of Madhya Pradesh (1989) the Supreme Court refused to let repeated representations stretch limitation.

Some people argue that pension coverage is a continuing matter, so limitation does not apply. That argument has some force for monthly pension already being paid wrongly, but it is weak when the dispute is about a one-time option with a fixed date. Do not build your case on it. If you are already outside the year, the tribunal can condone delay for sufficient cause under Section 21(3), and our page on filing late with a condonation application explains what reasons are accepted.

Mistakes that weaken OPS claims

  • Relying on the exam date alone. An exam held in 2003 under a notice of 2003 helps; an exam held in 2003 under a notice of 2002 helps even more. But a 2004 exam under a 2004 notice does not help however long the selection took.
  • Not asking for the file noting. Advocate B.K. Singh's usual first request in these matters is for the note sheet behind the rejection, obtained through RTI. It often shows the authority applied the wrong cut-off or never looked at the advertisement.
  • Comparing yourself with batchmates without proof. 'Others got it' is persuasive only when you can show the orders granting it to people recruited under the same notice.
  • Letting the corpus question frighten you off. Retirees often drop good claims because they assume they will have to pay back everything. Ask for the actual figure of the government share and returns before deciding.
  • Filing too early or too late. Going to the tribunal without a representation can lead to the OA being returned with a direction to represent first. Waiting two years after a clear rejection invites a limitation objection.

What to do this week

Find your appointment letter and look for the reference to the advertisement or examination under which you were selected. If it is there, you already have half the case. If it is not, write today to the recruiting agency under RTI asking for the notice number and date for your selection. Keep a copy of every letter you send and note the date you sent it.

If you received a rejection, put its date in your diary with a reminder ten months later. Advocate B.K. Singh often sees files where the employee had a sound claim but spent the year writing to the wrong office.

Our wider page on pension, PPO and gratuity disputes covers retirement benefits more generally, and the note on proving a pre-2004 advertisement goes deeper into the evidence. We settle fees at the first meeting and put them in writing for each stage; our process and fees page explains how.

If your OPS claim has been refused, delayed or never decided, speak to Advocate B.K. Singh about your papers, or ask him for the latest old pension orders.

Frequently asked questions

Is joining before 1 January 2004 required for old pension?

No. The 2023 order looks at when your vacancy was put out for recruitment: it must be 22 December 2003 or earlier. You could have joined in 2004, 2005 or later and still be eligible, provided you were appointed against that earlier recruitment.

Can I still apply for OPS in 2026 if I never opted?

The option window closed on 31 August 2023 and has not been reopened generally. A late claim has a chance only where the department failed to circulate the order or lost an option you gave on time, and you will need proof of that.

What happens to my NPS money if I get the old pension?

The NPS account is closed. Broadly, your own contributions with returns go into a GPF account and the government's share returns to the government. Ask the accounts office for a written statement of how the adjustment was done.

I retired under NPS. Can I still claim old pension?

A DoPPW clarification of October 2023 says retirement is not a bar if you are otherwise eligible. You will have to refund the government contribution and returns on it with interest, so work out the figures before deciding.

My result came in 2004 but the advertisement was in 2003. Am I covered?

Under the 2023 order, the advertisement or notification date is the test, so a 2004 result does not by itself disqualify you. The earlier February 2020 order looked at the result date, and some offices wrongly apply that test to 2023 claims.

Do compassionate appointees get old pension?

Yes, under a DoPPW order dated 22 June 2026, if the application for compassionate appointment was made by 31 December 2003 even though the appointment came later. Read the order and your department's instructions for the exact conditions.

Can CRPF or BSF personnel claim OPS before CAT?

No. CAPF personnel are outside the tribunal's jurisdiction and must approach the High Court. Their own old pension litigation has followed a separate path, so check its current status before filing.

How long does a CAT case for old pension take?

Expect one to three years between filing and judgment. Benches with heavy lists, and departments slow to file a counter, push it to the longer end. Implementation after the order can take a further few months.
