In short. Noida and Greater Noida are in Gautam Buddh Nagar district, which falls under the Central Administrative Tribunal's Allahabad Bench at Prayagraj. Most central staff who live here, though, travel to Delhi for work, and for them the Principal Bench in New Delhi is the forum. Your posting and the office that signed the order settle it; retired people may also rely on their Noida home. A defended case lasts roughly one to three years. Our Vaishali office is a short drive away, and online consultations are available.
Is this your situation?
- You are posted in a central office in Noida or Greater Noida, such as a Kendriya Vidyalaya, a post office, a CGST or income tax office, or the Navodaya Vidyalaya Samiti headquarters.
- You live in a Noida sector or in Greater Noida West but work in a ministry, railway office or other central department in Delhi.
- After retiring from a central job in another state, you settled in Noida near your children.
- Your PPO, pension, gratuity or a family pension has gone wrong or is held up, and the right forum is unclear.
- You have received a charge memo, penalty or transfer order and want to know how to challenge it from Noida.
- You work for the Noida Authority, a PSU, a bank or the CISF and someone has suggested the CAT.
The first question: is your office in Noida, or in Delhi?
While you are serving, the tribunal does not care where you sleep at night. Rule 6 of the procedure rules ties the bench to your posting and to the place the grievance came from. That is why two central employees in the same Sector 78 housing society can end up before different benches, with different High Courts above them.
If you are posted in Noida or Greater Noida, your home bench is the Allahabad Bench at Prayagraj, because Gautam Buddh Nagar district lies in its territory. Delhi's Principal Bench comes into the picture only where the impugned order was signed in Delhi or some other piece of the dispute happened there.
If you live in Noida but are posted in Delhi, your case goes to the Principal Bench, as it would for any Delhi employee. Your Noida flat does not change that.
If you have retired, been removed or dismissed, Rule 6(2) adds one more option, your place of residence, which for Noida points to Prayagraj. Yet a typical Noida retiree spent his last posting in Delhi or had his pension settled by a Delhi office, which makes Copernicus Marg available as well, and it is far easier to get to.
Common Noida situations and where each one goes
| Your situation | Likely CAT bench | High Court for any writ |
|---|---|---|
| Posted in Noida; order passed by an office in Noida or elsewhere in UP | Allahabad Bench, Prayagraj | Allahabad High Court |
| Posted in Noida; transfer ordered by a headquarters in Delhi | Allahabad Bench or Principal Bench (choose one) | Allahabad or Delhi High Court, following the bench |
| Working in a Delhi ministry, home in a Noida sector | Principal Bench at Copernicus Marg | Delhi High Court |
| Retired from Delhi; living in Greater Noida West | Principal Bench, or Prayagraj by residence | Follows the bench chosen |
| Retired from a railway division in Bihar; now living in Noida | Bench where the dispute arose, or Prayagraj by residence | Follows the bench chosen |
| Employee of the Noida, Greater Noida or Yamuna Expressway authority | Not the CAT (state statutory body) | Allahabad High Court, or the state forum that applies |
| CISF or CRPF member posted in Noida or Greater Noida | Not the CAT (armed force of the Union) | A High Court by writ |
The rules behind those answers
Rule 6(1), CAT (Procedure) Rules, 1987
A serving applicant presents the OA at the bench covering his present station, or at the bench for the area where all or part of the grievance arose. Filing anywhere else needs the Chairman's leave, which is seldom sought.
Rule 6(2), CAT (Procedure) Rules, 1987
Someone no longer in service, by retirement or by dismissal, removal or termination, may also choose the bench for his usual home. Families claiming family pension generally rely on the same rule. So a man who retired in Kolkata and now lives in Sector 50 can file at Prayagraj.
Sections 20 and 21: remedies first, then twelve months
The tribunal wants to see that you appealed or represented first, but it does not make you wait beyond six months for an answer. The OA must then be filed within twelve months of the final decision, or of the day those six months ran out. A delay can be condoned for good cause, but the reasons must be specific.
Section 25, Administrative Tribunals Act, 1985
A pending OA can be moved to a different bench by order of the Chairman. For a Noida resident with a case pending at Prayagraj, this can be considered where attending there is a genuine hardship, though convenience alone is rarely enough. Our page on transfer of cases between benches explains the procedure.
Central offices in Noida and Greater Noida
Sector 62 holds several central institutions. The Navodaya Vidyalaya Samiti runs its headquarters there, so administrative staff at headquarters, and teachers whose transfers or disciplinary cases are decided there, often have a Noida link even when their school is in another state. The National Institute of Biologicals, under the Ministry of Health, and the National Institute of Open Schooling are also in that sector. Our page on Kendriya and Navodaya Vidyalaya teachers covers the education side.
Sector 24 has the ESIC hospital and the V.V. Giri National Labour Institute, and the district has its share of income tax, CGST and postal offices, EPFO establishments and Kendriya Vidyalayas. At Dadri, in Greater Noida, Customs staff work at the inland container depot.
One caution. Several Noida employers are autonomous bodies or societies rather than government departments. Their staff can use the tribunal only if the central government has issued a Section 14(2) notification naming that body. Some Noida institutes have one, some do not. Our page on ESIC and EPFO employees and the Section 14(2) notification shows how to check, and the same method works for any Noida institute.
Noida employers whose staff cannot use the CAT
- Noida, Greater Noida and Yamuna Expressway authorities. These are statutory bodies set up by the Uttar Pradesh government. Their staff are not central employees, and the CAT has no jurisdiction over them.
- Uttar Pradesh government offices. The district administration, UP police, state schools and other state departments in Gautam Buddh Nagar are state employers. For their staff, the forum is the state's services tribunal in Lucknow, or a High Court writ.
- Public sector companies and banks. Noida has large offices of central public sector companies and bank zonal offices. Unless the employer has been specially notified, which is unusual, their staff must go by writ.
- CISF, CRPF and other CAPF personnel. CISF members guard the Delhi Metro stations in Noida and industrial sites around Dadri, and the CRPF has an establishment in Greater Noida. Both forces are armed forces of the Union, so the CAT is closed to their members and a writ is the route. Our page on the right forum for CAPF and armed forces personnel explains this.
- Private companies and IT firms. Disputes there are matters of labour or contract law, not service law, and do not belong before the tribunal at all.
Pensioners in Noida and Greater Noida West
Many of our Noida callers are retired. Most of them served their whole careers elsewhere, in a Kolkata audit office, a Jabalpur ordnance factory, a Guwahati postal division, and moved to a flat in Greater Noida West or a Noida sector to live near a son or daughter. When their pension goes wrong, they assume they must fight it where they retired. Often they need not.
The residence option in Rule 6(2) takes a Noida pensioner to Prayagraj. That is a valid option, but a long way off. The alternative is the bench where the dispute arose. Where a Delhi office sanctioned, revised or reduced the pension, Delhi's bench can usually be used as well, and it is about an hour away by metro or road. Many pensioners therefore end up at Copernicus Marg even though Noida is technically Prayagraj territory.
The common disputes are familiar: a PPO that shows the wrong last pay, a family pension refused because a name was missing from the family details form, a recovery of an old overpayment from the pension, a delayed gratuity with no interest, or the extra increment denied to someone who retired a day before it fell due. For a fuller list, see our page on pension, PPO and gratuity not released.
Arrears are worth asking about. For years, pensioners were told they could get back only about three years of arrears. In 2026 the Supreme Court, in Maya Banerjee v. Union of India, refused to apply that limit to family pension and ordered payment from the date of death with interest. For pay claims, the three-year cap is still generally applied. Ask how this applies to your claim; it can multiply the amount involved.
Taking up a Noida case with our Vaishali office
Vaishali is a short drive from most Noida sectors, and many clients from here prefer to meet in person.
Call or message us
Tell us your post, where you are posted or living, what order you have received and when. We will ask you to send scans of the main order and your last representation before the meeting, so that the first discussion is useful.
First meeting in Vaishali or online
We go through the order, your service record and your timeline. We start with three facts: your station on the day of the order, the office that signed it, and the day you got it. Those three facts decide the bench and the limitation.
Settle the departmental stage
If you have not yet appealed or represented, that usually comes first. We may draft it for you, sent through your controlling officer to whoever has the power to grant it. If it is already pending, we check whether the six months have passed.
Choose the bench
Where both Prayagraj and the Principal Bench are open, we discuss which suits your evidence, the respondents and your own ability to attend. The choice is recorded in the OA with the facts that support it.
Draft and file
We prepare the OA, the list of dates, annexures, affidavit and vakalatnama. Filing at Delhi is done by our team; filing at Prayagraj is done online or through associate counsel there.
Hearings and updates
We appear at the Principal Bench; associate counsel appears at Prayagraj where needed, with the strategy staying with us. You get a short update after each date, even if the case was only adjourned.
After judgment
If you win, we serve the order and follow up on compliance. If the department files a writ, or if you lose and want to challenge the order, we advise on the High Court route.
Time and cost for a Noida employee
| Stage | Typical time | Fees payable to the tribunal or court |
|---|---|---|
| Appeal against a punishment | Rule 23 of the CCS (CCA) Rules allows 45 days; the appellate authority often takes a few months | None |
| Representation about pay, MACP or pension | Section 20 means you need not wait more than six months | None |
| Filing the OA | Twelve months from the final decision, or from the close of the six-month wait | The Rule 7 fee is Rs 50; check with the registry that the figure and mode of payment are unchanged |
| Admission and notice | Usually within weeks of a clean filing | Process fee, copies, postage |
| Reply, rejoinder and final hearing | About 1 to 3 years for a contested case | Affidavit and copying charges |
| Writ in the Allahabad or Delhi High Court | Filed promptly after the tribunal's order; may take another 1 to 3 years | A modest High Court fee plus paper books |
| Execution or contempt if the order is ignored | Weeks to months | Small |
A Kendriya Vidyalaya teacher in Greater Noida
Here's a made-up example. Meenakshi, 41, is a TGT (Mathematics) at a Kendriya Vidyalaya in Greater Noida. Her husband works as a section officer in a central office in Noida, and their daughter is in Class 10. In April she receives an order from KVS headquarters in Delhi transferring her to a Vidyalaya in Assam on the ground that she is the longest-serving teacher at her station.
She believes her displacement count was wrong, because her earlier years at another station should have been counted separately, and because her husband's posting in Noida entitles her to the spouse ground under the transfer policy. Her representation to KVS goes unanswered for six weeks, and the date for her relief from the Greater Noida school is approaching.
Her posting is in Gautam Buddh Nagar, so the Allahabad Bench has jurisdiction. The transfer order was passed in Delhi, so the Principal Bench does too. She chooses the Principal Bench: the order and the record are in Delhi, the KVS headquarters is the main respondent, and she can attend from Noida in an hour if needed. Her OA asks for the transfer to be set aside and, in the meantime, for her not to be relieved.
This is only an illustration. The tribunal might grant interim protection, or it might direct KVS to decide her representation within a short time and leave the transfer in place until then. Our guide on checking KVS displacement points explains how the count is worked out, and our page on spouse posting covers the other ground.
Which High Court sits above your bench
The High Court follows the bench, not your address. A Prayagraj decision is challenged before two judges of the Allahabad High Court, also at Prayagraj. A Copernicus Marg decision is challenged in the Delhi High Court. The pairing goes back to the Constitution Bench ruling in L. Chandra Kumar (1997).
For a Noida resident this matters more than people expect. The Delhi High Court is close; the Allahabad High Court is a long journey, though much of its work can be done through counsel. When both benches are open at the start, it is worth thinking ahead to where any writ would go. Each route is explained on our pages about Allahabad High Court service writs and the Principal Bench at Copernicus Marg.
Remember that departments file writs too. Winning at the tribunal may be followed by a writ from the department, and you will need to defend it. The tribunal's order binds the department unless the High Court stays it.
Prayagraj from Noida: distance, video hearings and practical choices
Prayagraj is more than 600 kilometres from Noida. For an employee whose case has to be heard there, the concern is understandable. In practice, most of the work does not need you to travel. Filing can be done online through the CAT e-filing portal, routine listings are attended by counsel, and video hearings are allowed at many benches on request, though the practice of each bench varies and should be checked.
A case at the Allahabad Bench is handled by our team and associate counsel who appear there regularly, with the drafting and decisions remaining with Advocate B.K. Singh. Clients usually travel only if the bench specifically requires it or for a final hearing they want to watch.
If you are posted in Noida and both benches are available, we will not choose Delhi just because it is convenient if the Delhi link is thin. A weak jurisdictional link invites an objection, and fighting over the bench wastes the first months of a case. Our Ghaziabad page, on central employees in Ghaziabad, deals with the same issue for the neighbouring district.
What to carry to Vaishali, or send ahead
- The order that hurts you, and anything showing the day it arrived
- Your posting order for Noida or Delhi, and your latest pay slip
- Copies of your appeal or representation, the diary number or postal receipt, and any answer
- Relevant pages of your service book or the e-HRMS e-Service Book
- For pensioners: PPO, last pay certificate, pension calculation sheet, and any revision or recovery letter
- For family pension: death certificate, Form 4 or the family details submitted by the employee, and the rejection letter
- For discipline: charge memo, inquiry report, your replies, penalty order and appellate order
- For transfers: the transfer policy, your representation, and any document supporting a spouse, medical or child-related ground
When a departmental case and a police case run together
Sometimes a Noida employee faces an FIR as well as a charge memo, say after a quarrel at a post office counter turns into a police complaint. The criminal case would be heard in the Gautam Buddh Nagar district courts at Surajpur, with procedure now governed by the BNSS for events after 1 July 2024, while the department pursues its own inquiry in parallel.
Two points need early attention. Custody beyond 48 hours brings in deemed suspension under Rule 10(2) of the CCS (CCA) Rules, effective from the day of detention, with or without a written order. And while the two proceedings can run together, a request to stay the departmental inquiry until the criminal case is decided is sometimes granted where the facts and witnesses are identical and the charge is serious. Our page on criminal trial and departmental proceedings on the same facts covers when such a stay is realistic.
Errors that cost Noida employees time
- Filing in Delhi while posted in Noida with no Delhi connection. The case may be returned. If every order in your matter was passed in Noida or Lucknow, Prayagraj is your bench.
- Assuming a Noida pensioner must file where he retired. Rule 6(2) gives you your residence as a basis, and the place where the order was made may give you Delhi.
- Writing to the wrong office. A representation addressed to a minister or sent directly to a headquarters, bypassing your controlling officer, may be ignored or even treated as misconduct. Route it through your own office to the officer who has power to decide.
- Letting the one-year limit slide while waiting for a reply. Reminders do not extend limitation. The clock runs from the final order, or from six months after you represented.
- Treating a Noida Authority or bank job like a central post. These employees go to the High Court, and time spent at the CAT is wasted.
How things differ for officers, Group C staff, candidates and families
Officers in Noida, such as income tax and CGST officers, NVS headquarters staff in Group A and B posts, and scientists, most often bring promotion, seniority, APAR and deputation cases. These usually need records held by the department, so an early RTI request or a direction from the tribunal to produce the DPC file can be decisive.
Group C staff, including postal assistants, multi-tasking staff, KV non-teaching staff and Customs and CGST ministerial staff, bring more cases about recovery, MACP and minor penalties. For them, the first line of defence against a recovery is usually Rafiq Masih (2015), which protects Group C staff from most recoveries of money wrongly paid by the department.
Candidates rejected in central recruitment, whether by the Staff Selection Commission, a Railway Recruitment Board or a central body with an office in Noida, file at the bench covering the recruiting office or the place they applied from. For a Noida candidate applying to a Delhi-based body, the Principal Bench is often appropriate.
Families of employees who died in service, claiming family pension, compassionate appointment or unpaid dues, can file where they live. For a widow in Noida, that is Prayagraj, though the Principal Bench may also be available if the department's decision came from Delhi.
When a letter is better than a case
A pay fixation slip that plainly conflicts with a government order, a missing increment, or a delayed gratuity are often set right by a clear representation that quotes the relevant rule or office memorandum and requests an answer by a named date. Filing an OA first can make an office defensive. If the representation fails, or is ignored for six months, the tribunal is still there.
The opposite applies where your job or income is threatened. A removal order, a large recovery from salary or pension, a transfer that will separate you from a dependent family member, or a reversion: these call for quick advice, because the one-year limit is applied strictly and interim relief is only possible once a case is filed. Advocate B.K. Singh usually puts it plainly at the first meeting: if you are losing money every month, waiting is rarely the right choice.
Our office near Noida
Our office in Vaishali, Ghaziabad is in Cloud9, Tower S3, Vaishali Sector 1, a short drive from most Noida sectors and from Greater Noida West. Our second office is in Dwarka, New Delhi, and a video consultation works well for anyone who would rather not travel. Our guide on meeting a service law advocate in Vaishali and Indirapuram explains what to expect.
We agree our fee when we first meet and write it down stage by stage, from the departmental representation to the OA and any later writ. We do not quote figures on this site.
This week, if you are in Noida with an order in hand
Note where you were posted when the order was made, where it was signed, and the date it reached you. Count one year from that date, or six months from your representation if no reply has come. Gather the papers in the checklist above and scan them into a single folder.
If a recovery, transfer or removal is about to take effect, do not wait for the department. Seek advice now, because interim relief depends on filing in time.
For a careful reading of your file, or to be told when a ruling affects claims like yours, get in touch with Advocate B.K. Singh.
Frequently asked questions
Which CAT bench covers Noida?
Both Noida and Greater Noida belong to Gautam Buddh Nagar, a district in the Prayagraj bench's territory. A Delhi posting, or an order signed in Delhi, makes the Principal Bench available.
I live in Noida but work in a Delhi ministry. Where do I file?
Copernicus Marg. During service, the bench follows your posting and the origin of the order; a Noida flat does not shift it.
Can a Noida pensioner file at the Principal Bench?
Yes, if the dispute arose in Delhi, for example because the pension was sanctioned or cut by a Delhi office. Otherwise, you can file at Prayagraj on the basis of your Noida residence.
Is there a CAT bench or circuit sitting in Noida?
No. There is no CAT bench or regular circuit sitting in Noida or Greater Noida. Cases are filed at Prayagraj or, where the facts allow, at the Principal Bench in Delhi.
Do Noida Authority employees go to the CAT?
No. The Noida Authority is a statutory body of the Uttar Pradesh government, so its staff are not central employees. Their disputes go to the High Court or another state forum.
Which High Court hears my case after the tribunal?
Whichever High Court is linked to the deciding bench: Allahabad for a Prayagraj order, Delhi for a Copernicus Marg order. Your home in Noida plays no part in that choice, so think about the writ stage when you first pick a bench.
Will I have to travel to Prayagraj for every hearing?
Rarely. Papers can be filed online, counsel covers the routine listings, and a video appearance can often be requested. You may need to attend only if the bench directs it.
Can I meet a lawyer near Noida for a central service case?
Yes. We see Noida clients at our Vaishali office in Ghaziabad, which most sectors can reach quickly, or by video. The fee is fixed in writing at that first meeting.
