Children Education Allowance Rejected: Common Reasons and Fixes

In short. A children education allowance rejected by your office can usually be put right with the correct proof, because most CEA claims fail on paperwork rather than entitlement. CEA is a fixed Rs 2,812.50 a month per child for two children, with hostel subsidy up to Rs 8,437.50 a month. Find the exact reason, refile with the right certificate within weeks, and ask for any final refusal in writing. If the office still says no, a representation and then an application to the Central Administrative Tribunal within one year of the refusal is the route.

Is this your situation?

  • Your CEA claim came back with a note such as 'certificate not in prescribed format' or 'not admissible'.
  • The school refused to give a head of institution certificate and the office will not take the report card.
  • Hostel subsidy was cut because the receipt shows one combined amount for tuition and boarding.
  • Your claim for a third child was rejected although your second delivery was twins.
  • Your spouse also works for the government and the office suspects a double claim.
  • You submitted the claim more than a year late and were told it is time-barred.
  • The office now says hostel subsidy paid in earlier years exceeded what you actually spent and wants it back.

In short

  • CEA is a fixed sum, not a refund of fees. The office needs proof that the child studied for the year, not a bill for every rupee spent, so a demand for itemised fee receipts for CEA is misplaced.
  • Three kinds of proof are acceptable. A certificate from the head of the institution, or a self-attested report card, or self-attested fee receipts covering the whole academic year.
  • Hostel subsidy is different. It is the lower of actual boarding and lodging cost or the ceiling, and the 30 June 2026 corrigendum makes that clear, so you need a receipt that separates hostel charges.
  • The two-child limit has exceptions. Twins or more at the second birth, and a child born after a failed sterilisation, are covered.
  • Get the reason in writing. A returned bill with a pencil note is not a rejection you can challenge; a signed communication with a reason is.
  • Watch the one-year clock. A rejected annual claim is a one-time loss, so the tribunal is stricter about delay here than in monthly pay cases.

What the CEA rules actually require

The present scheme comes from the Seventh Pay Commission and was put in place by DoPT's order of 16 August 2017, consolidated on 17 July 2018. It applies to regular central government employees for their two eldest surviving children, from nursery to Class 12, including the two pre-primary years before Class 1. Classes 11 and 12 in a junior college count. For a diploma or certificate course at a polytechnic or ITI started after Class 10, the first two years are covered if no CEA was drawn for Classes 11 and 12.

The amount rises by 25 percent each time dearness allowance crosses another 50 percent. After DA reached 50 percent on 1 January 2024, the CEA became Rs 2,812.50 a month per child (Rs 33,750 a year), and the ceiling for hostel subsidy became Rs 8,437.50 a month (Rs 1,01,250 a year). For a child with a disability CEA is double, now Rs 5,625 a month.

Age matters too. A child is covered up to 20 years of age or passing Class 12, whichever comes first. For a child with a disability the limit is 22 years, and there is no minimum age. Children studying by correspondence or distance learning are covered subject to the same conditions.

The claim is made once a year, after the year ends. Most offices take it in April or May for the previous academic year. You do not need to claim each quarter, and an office that insists on it is following an old habit, not a rule.

The CEA certificate problem, and the easy way around it

The single most common reason a CEA claim is returned is the certificate. The preferred proof is a certificate from the head of the institution stating that the child studied there during the previous academic year. Many private schools now refuse to sign anything beyond their standard report card, and some principals simply are not available in May.

The 2018 consolidated order anticipated this. Where the certificate cannot be had, a self-attested copy of the report card, or self-attested fee receipts (e-receipts count) for the whole academic year, is enough for CEA. The word 'whole' is the trap: if you attach receipts for only two quarters, the office can properly ask for the rest.

Advocate B.K. Singh's first tip is to collect the proof when the school year closes, not when the claim is due. Ask the school office for the head of institution certificate in the last week of the session, with a separate figure for hostel charges if the child boards, and keep the final report card and every fee receipt in one envelope. A claim built that way rarely comes back.

Hostel subsidy: what changed in June 2026

Hostel subsidy is payable only where the child lives in a residential school or hostel at least 50 kilometres from your residence. It can be drawn along with CEA for the same child. Unlike CEA, it is never a fixed amount: it is the actual boarding and lodging expense or the ceiling, whichever is lower.

In 2024 DoPT's notice of the revised rates was read by some offices as fixing the hostel subsidy at the full ceiling. A corrigendum dated 30 June 2026 cleared this up: the ceiling is Rs 8,437.50 a month, but reimbursement cannot exceed what you actually paid for boarding and lodging. Tuition, transport and uniform are not part of it.

Two practical results follow. First, your receipt must separate hostel charges from tuition, or the head of institution's certificate must state the boarding and lodging figure. Second, if your office paid you the full ceiling in 2024 or 2025 when your real hostel cost was lower, it may now raise an audit point. That recovery question is dealt with further below.

Third child, twins and failed sterilisation

CEA is limited to the two eldest surviving children. A third child is not covered as a rule, but there are two exceptions written into the orders. If the second childbirth results in twins or more, all those children are covered. And if a child is born after the first failure of a sterilisation operation, that child is covered too.

Proof is what wins these claims. For twins, the birth certificates with the same date and the hospital discharge summary are enough. For a failed sterilisation, you need the record of the operation and the record showing the subsequent birth, and the office may ask for a medical certificate linking the two.

Note the word 'surviving'. If the eldest child has died, the next two children are the eligible ones. Offices sometimes keep the original two names on record and refuse the younger child; a short letter with the death certificate puts this right.

A child with a disability: double rate and a later age limit

For a child with a disability, CEA is paid at twice the normal rate, Rs 5,625 a month at present, and continues up to 22 years of age instead of 20. The child can also be in an institution that is aided or approved by government, or whose fees are approved by government, even if it is not formally recognised as a school. Many special schools and therapy-linked institutions fall in that group.

Rejections here usually come from offices that apply the ordinary checklist: they see a 21-year-old, or an institution without a board affiliation, and stop. Attach the child's disability certificate or UDID card, and a letter from the institution about its approval or aid, with the first claim. Once the office records the child as a child with a disability, later years tend to pass without argument.

If the child's certificate is temporary, renew it before it lapses and send the new one with the next claim. A gap of a few months between certificates should not cost you the year, but you may have to explain it.

Transfer, deputation or a change of school during the year

A transfer in the middle of the academic year does not split the claim between offices in any neat way. Most offices let the one where you are serving when the year ends take the whole claim, and many of them ask the earlier office for a certificate that nothing was paid there. Ask your old office for that certificate before you leave, because chasing it later from another city is slow.

On deputation to another central department or an autonomous body, CEA is paid by the borrowing organisation under the same rules. If the borrowing body has its own scheme and you have opted for its pay structure, its scheme applies instead; check your deputation terms.

If the child changes school during the year because of your transfer, attach proof from both schools: a transfer certificate from the first and an admission or report card from the second. The full year is covered as long as the child is not admitted to a class already passed.

Two made-up examples: a lump-sum hostel receipt and a twin

Here's a made-up example. Raghav, an income tax inspector in Nagpur, has a daughter in a residential school in Pune, well over 50 kilometres away. For 2025-26 he claimed CEA and hostel subsidy and attached the school's single receipt for Rs 2,40,000 covering tuition, boarding and activities. The office passed the CEA but rejected hostel subsidy entirely. Raghav asked the school's bursar for a certificate splitting the amount; it showed Rs 96,000 for boarding and lodging. He refiled. The office paid Rs 96,000 as hostel subsidy, because that was below the annual ceiling of Rs 1,01,250.

A second made-up example. Fatima, a Level 6 nurse at a CGHS dispensary in Lucknow, has an elder son and then twin daughters. Her office paid CEA for the son and one twin and refused the other twin as a 'third child'. She attached both birth certificates showing the same date of birth and a page from the 2018 order on twins. The claim for the second twin was admitted for the year, and the office corrected its record so it would not recur.

Smaller grounds that still sink claims

  • Change of school in mid-session to the same class. If the child had already passed that class, or is admitted again to the same class in a new school, CEA for that repeated year is not reimbursable. Failing a class in the same school is different: poor performance does not stop reimbursement.
  • Unrecognised nursery or primary school. A school not affiliated to any board must at least be recognised by the state, a UT administration or a competent local education authority. Ask the school for its recognition order before the session starts.
  • Both parents in government. Only one of you can claim. If your spouse works in a state government, PSU or bank, the office may ask for a certificate from the spouse's employer that no such allowance was drawn there.
  • Dies non periods. CEA is payable during leave, including extraordinary leave, and during suspension. It is not payable for any period treated as dies non.
  • Coaching and private tuition. These are not covered. A receipt from a coaching centre is not proof of schooling even if the child attends daily.

Steps after a CEA claim is returned or rejected

  1. Read the exact reason

Look at the endorsement or note on the returned bill. If there is only a pencil mark or an oral message, ask the section in writing for the reason and the paragraph of the order relied on.

  2. Match it against the table above

Most reasons are curable with a different document. If the objection is about proof, refile with the right paper within two or three weeks, with a covering note referring to the original date of submission.

  3. If the reason is about entitlement, write a short reply

Third child, age, recognition of school or a dies non period are questions of rule, not paper. Set out the facts, quote the relevant part of the 17 July 2018 order and ask for reconsideration.

  4. Escalate to the head of office

If the dealing section repeats the objection, put the same letter to the head of office or the controlling officer. Many rejections are reversed at this level because the head of office can admit an old or doubtful claim after verification.

  5. Make a formal representation

If the head of office also refuses, send a representation through proper channel to the authority competent to decide. Under Section 20 of the Administrative Tribunals Act you should ordinarily wait for its decision, or for six months, before going to CAT.

  6. File an Original Application

After a reasoned rejection or six months of silence, an OA under Section 19 can ask the tribunal to quash the refusal and direct payment. Keep within one year of the final rejection, because this is a one-time claim.

Your CEA claim file

  • Claim form as used by your office (paper or e-HRMS), signed and dated
  • Head of institution certificate for the previous academic year, or a self-attested report card, or self-attested fee receipts for the whole year
  • For hostel subsidy: certificate or receipt showing boarding and lodging charges separately, and proof the school is at least 50 km from your residence
  • Birth certificates of the children if the age or birth order is in question
  • Twins or sterilisation-failure records, if claiming beyond two children
  • Disability certificate of the child, if claiming the double rate or beyond age 20
  • Declaration that your spouse is not claiming, and the spouse's office certificate if needed
  • Recognition order of the school if it is not affiliated to a board
  • Copies of every returned bill and note, with dates

Late claims: delay is a nuisance, not usually a bar

The CEA orders do not set a short deadline for claiming. What happens in practice is that claims more than a year old are treated with caution: accounts staff ask for verification and the head of office's approval before passing them. That is a delay, and it is irritating, but it is not a lawful ground to reject an otherwise valid claim.

Write a short note with the late claim explaining the reason, for example a transfer in the middle of the year, a school that issued the certificate late, or illness in the family. Attach the proof. Ask specifically that it be admitted after verification by the head of office.

Where the office still refuses because of delay alone, it should say so in writing and name the rule. If it cannot, that refusal is open to challenge. Keep in mind that your own delay in challenging the refusal can hurt more than the original delay in claiming, which is why the one-year clock under Section 21 matters. Our guide on the one-year limit after a final order explains how it runs.

Children of employees who died, retired or left service

If a central government employee dies in service, CEA continues for the children, subject to the other conditions, up to the time the employee would have been entitled to it. The last office where the employee worked pays it. The exception is where the surviving spouse is employed in a central or state government office, autonomous body, PSU or other government-funded organisation; then this continued CEA is not payable.

Where an employee retires, is discharged, or is dismissed or removed, CEA is payable until the end of the academic year in which that happens. Families often miss this last claim in the confusion of retirement. Retiring employees should file the final year's claim along with their other dues.

A widow who is herself a central employee in another office can, of course, claim CEA in her own right from her own office. The continued benefit attached to the deceased spouse's service is what stops, not her own entitlement.

Recovery of CEA or hostel subsidy already paid

After the June 2026 corrigendum, some offices may revisit hostel subsidy paid at the full ceiling when the actual expense was lower. Others recover CEA paid for a third child or for a year of repetition. In either case, ask first for the audit para and a worked calculation. Then compare it with your receipts; offices sometimes include amounts that were properly paid.

Where you disclosed everything and the office simply read the order generously, the money was paid on its judgment, not your misstatement. That is the setting in which State of Punjab v. Rafiq Masih (2015) shields many employees. A Group C clerk, a pensioner, someone in the last year of service, or anyone asked to repay sums more than five years old stands on firm ground. An undertaking to refund, signed when the claim was passed, weakens that protection, so look for one in your old papers.

Which forum hears a CEA dispute

A refusal of CEA or hostel subsidy is a service matter, so a central government civilian employee goes to the Central Administrative Tribunal bench that covers the place of posting. Employees of bodies notified under Section 14(2), such as Kendriya Vidyalaya Sangathan, CSIR and many other central autonomous bodies, also go to CAT. Our page for KVS and NVS teachers covers their particular orders and forum.

Railway employees claim under Railway Board orders that adopt the DoPT scheme, such as RBE No. 114/2018 (consolidated instructions) and RBE No. 40/2024 (revised rates), and also go to CAT. Defence civilians claim through their units and the CDA, and go to CAT. CAPF personnel, PSU staff and bank employees have their own education allowance schemes and generally go to the High Court.

In most CEA cases the amount is modest, so the OA is usually limited to directing payment and correcting the office's reading of the order. Where many employees in one office face the same wrong reading, a joint application is often more sensible than individual cases. Our page on allowances refused or stopped mid-service explains how these cases are framed in CAT.

How long each stage takes and what it costs

StageTypical timeCost
Refiling with the right document2 to 6 weeks for the bill to passNone
Reply to the head of office on a rule question4 to 8 weeksNone
Representation to the competent authorityUp to 6 months for a decisionNone
OA before CATCommonly 6 to 18 months to a final orderRs 50 OA fee under Rule 7 (verify with the registry), photocopying and counsel's fee agreed in writing
Payment after a CAT orderUsually within the period the order sets, often 2 to 3 monthsNone, unless the office ignores the order

Allowances that often get mixed up with CEA

Women employees with disabilities receive a special allowance for child care, now Rs 3,750 a month, from the child's birth until the child is two years old. It is separate from CEA and is paid monthly, not annually. If you are entitled to both, check that both appear. For an employee with a disability, our guide on double transport allowance covers another benefit linked to the same certificate.

Child care leave is a leave entitlement, not an allowance, and disputes about it follow different rules; see child care leave refused. If your office has also reopened an old LTC claim or recalculated HRA, our guides on LTC claims rejected years later and HRA and surrendered quarters may help.

Before you refile

Lay your returned bill next to the checklist above and find the one missing paper. In most cases that is the whole problem. If the objection is about entitlement rather than proof, write the short reply described in the steps and ask for a decision in writing.

Advocate B.K. Singh's second tip: when you write back, ask the office to quote the paragraph of the 17 July 2018 consolidated order on which it relies. Many rejections cannot point to one, and a request framed that way often brings a quiet correction rather than a long correspondence.

If a recovery has started, or a refusal has hardened into a formal order, keep the dates in front of you and act within the year. You can ask Advocate B.K. Singh to look at your claim papers or for the latest position on CEA and hostel subsidy.

Frequently asked questions

Can I claim CEA if my child studies in a school abroad?

Generally no. The scheme is built around schools in India, with a narrow exception for children of Nepalese or Bhutanese citizens in central service who study in their native place. If you are posted abroad, your mission's own allowances usually apply instead.

Is CEA taxable?

Under the old income tax regime a small part of CEA and hostel subsidy is exempt and the rest is taxed; under the new regime the exemption is not available. Ask your DDO how it has been treated on your Form 16.

My child failed Class 9. Will CEA be refused?

No, if the child repeats Class 9 in the same school. The orders say poor performance does not stop reimbursement. It is different if the child moves to a new school and is admitted to a class already passed.

Does the office need the original fee receipts?

For CEA, self-attested copies are enough. For hostel subsidy, the 2018 order asks for the report card and the original receipts (e-receipts count) where the head of institution's certificate is not available.

My husband is in the state government. Can I claim?

Yes. Only one parent can claim, so you will usually be asked for a declaration and possibly a certificate from his office that he has not drawn a similar allowance for the same child.

Can I claim CEA for my adopted child or stepchild?

Generally yes, if the child is legally adopted or is a stepchild wholly dependent on you, and falls within the two eldest surviving children. Keep the adoption deed, or the marriage and custody papers, ready, because offices usually ask for them with the first claim.

Is hostel subsidy paid if my child lives with relatives in another city?

No. Hostel subsidy is for a residential institution or its hostel at least 50 km away. Living with relatives, however far, does not qualify.

My claim for 2023-24 was rejected in 2024. Is it too late to go to CAT?

It may be. A one-time claim rejected in 2024 generally has to be challenged within one year of the final rejection, unless delay can be explained and condoned under Section 21(3). Take advice quickly on whether a fresh representation or a condonation application is realistic.
