In short. An MACP calculation decides three things: when your upgradation was due, which pay level it should place you in, and how much arrears you are owed. This page sets out the order in which Advocate B.K. Singh checks those figures before any case is filed, so that central employees and retirees can do the same with their own papers. The check takes one or two sittings once the documents are collected. If the numbers show a real shortfall, the next step is a precise representation, and a CAT case only if that fails.
Is this your situation?
- Your MACP has not been granted although you believe the 10, 20 or 30 years are complete.
- MACP was granted, but from a later date than you expected.
- The pay fixed on MACP looks lower than a colleague's who was upgraded at the same time.
- The department says your MACP is in the 'next level', not the next post in your cadre.
- You are owed MACP arrears but nobody can tell you the amount.
- You are retired and an MACP that was never given affects your pension.
- You want to know whether your MACP claim is worth taking to the tribunal at all.
In short
- Build a dated timeline of your service before anything else. Every MACP figure depends on four or five dates, and the department's own records are the only proof that counts.
- Work out the due date from regular service, not from the date the committee met. MACP is due on completing the years, subject to fitness.
- Expect the next level in the pay matrix, not the next post. The Supreme Court upheld that reading of the scheme in 2020.
- Re-run the pay fixation, including the date of next increment and the option. Many MACP disputes are really fixation disputes.
- Calculate the arrears month by month with the dearness allowance of each period. The amount guides whether a case is worth filing and what to ask for.
- Keep pay claims within about three years where you can. Older arrears for pay are commonly cut off, so delay costs money.
Why the arithmetic comes before the argument
Most people arrive with a grievance: 'my MACP is late' or 'my batchmate got more'. Advocate B.K. Singh's first step is to turn that into numbers. A department replying to a representation or an OA will answer with a calculation of its own. If you do not have yours, you cannot show where theirs goes wrong, and the tribunal will usually accept the official figure.
Numbers also decide what relief to ask for. An OA that asks for 'MACP with all consequential benefits' leaves the department to work out the figure, often wrongly, and can lead to a second round of litigation. An OA that states the due date, the level, the cell and the arrears period gives the tribunal something precise to direct.
And the arithmetic tells you whether to file at all. Some MACP shortfalls are a few thousand rupees in total; some run into lakhs once pension is affected. Some apparent errors disappear once the service book is read properly. It is better to learn that at a desk than after a year in court.
The order in which he checks an MACP calculation
The sequence matters, because each step depends on the one before it.
Build the service timeline
List every event from the first regular appointment: confirmations, promotions, earlier upgradations under ACP or MACP, transfers, breaks, penalties and pay revisions, each with its date and the document that proves it.
Find the due dates
Mark the dates on which 10, 20 and 30 years of regular service from your entry grade are complete, and separately the date on which you finish 10 years in one level after your last move up.
Fix the right level
Identify the next level in the pay matrix for each upgradation. For pre-2016 upgradations, identify the next grade pay in the old hierarchy and its 7th CPC equivalent.
Test fitness and bars
Check the benchmark, the APARs the screening committee should have read, any penalty current at the due date, and any refusal of promotion.
Recompute the pay fixation
Apply one increment in the existing level and placement in the next level, then fix the date of next increment. Run the option route as well and compare.
Calculate the arrears
Work out month by month the difference in basic pay and the dearness allowance on it at each period's rate, then add allowances that depend on basic.
Check limitation and forum
Count how far back the claim can reach, whether a representation has been made and decided, and which bench or court has jurisdiction.
The service timeline sheet
| Date | Event | Level or grade pay | Proof |
|---|---|---|---|
| 1 March 2014 | Regular appointment as Multi-Tasking Staff | Grade pay Rs 1,800 (now Level 1) | Appointment order, joining report |
| 1 January 2016 | Pay revised under 7th CPC | Level 1 | Fixation statement under the 2016 Rules |
| 1 March 2016 | Probation declared complete | Level 1 | Office order |
| 1 July each year | Annual increments | Level 1 | Service book entries |
| Nil | No promotion, no ACP or MACP, no penalty | Service book; vigilance status | |
| 1 March 2024 | 10 years of regular service complete; first MACP due | Level 2 due | Calculation from the dates above |
| As of October 2026 | MACP not yet granted | Still Level 1 | Pay slips |
Counting the years the way the scheme counts them
The clock starts on the day you were regularly appointed to the grade you entered the service in. Years spent as a casual worker, on contract or on an ad hoc arrangement before that day are normally left out, the exception being where a court or tribunal has directed that they be treated as regular. Probation is inside the count, since a probationer holds a regular appointment. Periods treated as duty count. A period treated as dies non, unauthorised absence or a break in service usually does not, and long leave without pay should be checked against the current DoPT clarifications. The timeline should mark such periods so they can be subtracted if needed.
Earlier promotions and upgradations count against your three MACPs. If you were promoted once in your first ten years, you are entitled to two further upgradations, not three. The scheme also allows an upgradation when you have spent ten years continuously in the same level, even if the 20 or 30 year mark has not come, so the check has to run both ways: from the start of service, and from the last promotion or upgradation.
Transfers raise their own question. Regular service in a previous office counts for MACP, including after a transfer at your own request with bottom seniority; the guide on seniority after a request transfer touches on this. A fresh direct recruitment to a different post is treated differently. The quick tests are set out in our MACP checklist before you complain, and the timeline sheet is how those tests are applied to a real person.
Checking the level: MACP grade pay and the pay matrix
An upgradation lifts you one step up the matrix itself; it does not hand you the pay of the post you would have been promoted to. The 2009 version worked on grade pays in the same way. A person stuck at grade pay Rs 2,800 moved up to Rs 4,200, the next grade pay in the pay band structure, even if the next post in his cadre carried Rs 4,600. In Union of India v. M.V. Mohanan Nair (2020), the Supreme Court upheld this design. Arguments that MACP should follow the promotional hierarchy now rarely succeed.
Under the 7th CPC, the same idea operates on levels. An employee in Level 5 moves to Level 6, not to whatever level his promotion post carries. For an upgradation earned before 1 January 2016, the MACP grade pay is checked first and then carried into the matrix through the fitment on 1 January 2016. Mixing the two systems is a common source of error, especially for those whose first MACP was in 2012 or 2014 and second in 2022 or 2024.
There are a few cadres where special orders or court decisions have given a different result for a particular grade. Before assuming the general rule applies, Advocate B.K. Singh checks whether the department has issued a cadre-specific MACP order, and whether any judgment covering the same cadre has been implemented for others.
Benchmark, penalties and what the committee actually saw
MACP is non-functional, but it is not automatic. A screening committee looks at the APARs, and for upgradations from 25 July 2016 the benchmark is 'Very Good'. A grading below that, which was never disclosed to you, is a separate line of attack, explained in the guide on MACP refused for APAR grading.
A penalty current on the due date defers the upgradation; a pending chargesheet usually means the sealed cover procedure. Refusing a regular promotion can also lead to withdrawal or deferment of MACP, as discussed in the guide on MACP withdrawn after refusing promotion.
For the calculation, the point is simple: if the committee found you unfit or deferred you for a valid reason, the due date moves and every later figure moves with it. So the check asks for the committee's minutes or at least the decision, and notes the reason in the timeline before any money is worked out.
Re-running the MACP pay fixation
The fixation copies promotion. Your pay first moves one cell down your present level, and that figure is then matched to the next level, taking the same amount or the first cell above it. The next increment follows on 1 January or 1 July under Rule 10 and the DoE OM of 28 November 2019, which require six months of qualifying service. An MACP effective between 2 January and 1 July usually carries the next increment to the following 1 January; one effective between 2 July and 1 January carries it to the following 1 July.
The option to have pay fixed from the date of next increment applies to financial upgradations as well as promotions. Advocate B.K. Singh runs both routes and compares them over the next few years, not only the first month, because the route that pays less at the start often pays more later. If the office has not yet issued the MACP order, there is still time to give the option. Our guide on checking a pay fixation statement line by line covers the mechanics.
Where an MACP is granted late, the office will fix pay from the due date notionally. Check whether the arrears are from the same date. An order that grants MACP 'notionally from 2024, with actual benefit from the date of issue' needs a specific reason, and a delay by the office is not one.
Made-up example: a Multi-Tasking Staff member at a Chennai customs office
Here's a made-up example. Karthik was appointed regularly as Multi-Tasking Staff at a customs office in Chennai on 1 March 2014. He had no promotion, no penalty and no adverse APAR. His first MACP fell due on 1 March 2024. By October 2026, the screening committee had still not met for his batch, and the office had told him only that 'the matter is under process'.
His service book showed basic pay of Rs 24,200 in Level 1 on 1 March 2024, with an increment date of 1 July. On MACP from that date, one increment in Level 1 takes him to Rs 24,900, and the matching cell in Level 2 is Rs 25,200. The next increment falls on 1 January 2025, giving Rs 26,000, and on 1 January 2026, giving Rs 26,800. Without MACP, his Level 1 pay would have risen to Rs 24,900 on 1 July 2024, Rs 25,600 on 1 July 2025 and Rs 26,400 on 1 July 2026.
A draft order he obtained showed MACP from 1 March 2024 at Rs 25,200 but kept his increment date as 1 July. So the delay was not the only problem: the frozen increment date, on its own, would have cost him every year. The table below sets out the arrears on the correct basis, with the option route discussed after it.
MACP arrears worked out month by month
| Period | Basic with MACP | Basic without MACP | Monthly difference | DA rate | Basic plus DA arrears for the period |
|---|---|---|---|---|---|
| March to June 2024 (4 months) | Rs 25,200 | Rs 24,200 | Rs 1,000 | 50% | Rs 6,000 |
| July to December 2024 (6 months) | Rs 25,200 | Rs 24,900 | Rs 300 | 53% | Rs 2,754 |
| January to June 2025 (6 months) | Rs 26,000 | Rs 24,900 | Rs 1,100 | 55% | Rs 10,230 |
| July to December 2025 (6 months) | Rs 26,000 | Rs 25,600 | Rs 400 | 58% | Rs 3,792 |
| January to June 2026 (6 months) | Rs 26,800 | Rs 25,600 | Rs 1,200 | 60% | Rs 11,520 |
| July to October 2026 (4 months) | Rs 26,800 | Rs 26,400 | Rs 400 | 60% (July 2026 rate not yet announced) | Rs 2,560 |
| Total to October 2026 | Rs 23,600 in basic | Rs 36,856 |
Reading the arrears table
The difference swings between Rs 300 and Rs 1,200 because the MACP moved Karthik's increment date to January while his notional Level 1 pay kept rising each July. That is normal, and a calculation that applies a single flat difference for all months is wrong in one direction or the other.
Basic and dearness allowance are not the whole claim. House rent allowance is paid on basic, so for a Chennai posting (an X class city, at 30 per cent) the Rs 23,600 difference in basic adds about Rs 7,080. Transport allowance may change if the level crosses a slab. Against that, NPS contributions of 10 per cent of basic plus DA on the arrears will be deducted, with the government's share credited to his account. When the July 2026 DA rate is announced, the last row will increase.
Then the option. If Karthik opts for fixation from his next increment date, his pay is first placed at Rs 24,500 in Level 2 on 1 March 2024, then re-fixed on 1 July 2024: Rs 24,900 after the annual increment, Rs 25,600 after the notional one, and Rs 26,000 in Level 2. His next increments come on 1 January 2025 (Rs 26,800) and 1 January 2026 (Rs 27,600). He draws Rs 700 a month less for March to June 2024, and Rs 800 a month more from July 2024 onwards. Over a career that runs to his next upgradation, the option route is clearly better here, and since no MACP order has been issued, he can still choose it.
MACP arrears: how far back the claim reaches
A wrong or missing MACP is a continuing wrong, because pay is short every month. That keeps the claim alive, but it does not keep all the money alive. For pay claims, tribunals still commonly follow Union of India v. Tarsem Singh (2008) and limit arrears to about three years before the OA is filed. The upgradation itself, and its effect on future pay and pension, is not cut down in the same way.
In 2026 the Supreme Court refused to apply that three-year cap to some pension claims, including family pension and disability pension cases. For an MACP claim by a serving employee, the cap is still the usual approach. For a retiree whose pension is affected, the position is more open, and it is worth checking the latest decisions before deciding what to ask for. Our guide on continuing wrongs and old pay and pension claims goes into the limits.
Interest on delayed MACP arrears is not automatic. Tribunals award it in some cases, usually where the delay was plainly the department's fault and lasted long. Ask for it, but do not build the case around it.
What changes when the employee has already retired
A retiree's MACP check has one more layer. If the upgradation should have come before retirement, the last pay drawn was too low, and so were the pension, the commuted value, gratuity and leave encashment. The calculation therefore runs past the retirement date: what the last pay should have been, what pension follows from it under Rule 44 of the CCS (Pension) Rules, 2021, and which lump sums change.
The paperwork is also harder to get. The office that held the service book may have closed or moved, and the pension file sits with the Pay and Accounts Office. Advocate B.K. Singh asks retirees for the pension payment order, the last pay certificate and the pension calculation sheet first, because those three papers show the figures the PAO used and make it possible to work backwards.
Family pensioners can raise the same claim where the employee died with an MACP still unpaid. The unpaid arrears are payable to the family as the employee's dues, and the higher last pay also raises the family pension. Because some 2026 Supreme Court decisions have treated pension arrears more generously than pay arrears, the period claimed for each part should be worked out separately.

- Every promotion, ACP and MACP order, with dates of effect
- Orders on breaks, dies non, suspension periods or regularisation of earlier service
Screening and conduct
- APARs for the years the committee would have read, and proof of disclosure
- Screening committee decision or minutes, if available

- Any draft MACP order or calculation sheet received
- Your option letter, if given
Correspondence
- Representations with diary numbers and dates
- Replies and rejection letters
- Orders granting MACP to colleagues in the same position, if available
Calculation errors he sees most often
- Counting from confirmation instead of regular appointment. Probation is regular service. Counting from the end of probation pushes the due date back by two years or more.
- Placing the upgrade in the promotional post's level. This overpays, and the excess is later recovered, sometimes at retirement.
- Ignoring the ten-years-in-the-same-level rule. Someone promoted early may become due for an upgradation well before the 20 or 30 year mark.
- Leaving the increment date unchanged. As in the example, all figures can be right and the date wrong.
- Starting the arrears from the order date. Unless there is a valid deferment, the money is due from the due date.
- Using one DA rate for the whole period. Dearness allowance changes twice a year, and each period's rate has to be applied separately.
When the numbers say do not file
Some checks end with advice not to litigate. If the committee deferred the upgradation because of a valid penalty or an APAR below benchmark that was disclosed and upheld on representation, the department's date is probably right. If the shortfall is a few hundred rupees from a rounding difference and the office is willing to correct it, a letter is enough.
Sometimes the check uncovers an overpayment. A person who wants a higher MACP level may find that his earlier fixation was too generous. Raising the dispute can lead the office to re-examine everything and propose recovery. That risk has to be weighed honestly, and the protections against recovery for Group C staff and retirees are relevant here.
And sometimes the claim is real but old. If most of the arrears fall outside the period a tribunal is likely to allow, the case may still be worth filing for the future pay and pension, but the client should know in advance what the money side will probably look like.
Time and cost of an MACP dispute
| Stage | Usual duration | Cost in general terms |
|---|---|---|
| Collecting documents, including RTI where needed | Two to six weeks | Rs 10 per RTI application to a central public authority, plus copying charges |
| The calculation check | One or two sittings once papers are in hand | Part of the consultation; the fee is agreed in writing at the first meeting |
| Representation to the department | Six months for a decision before the tribunal route opens under Section 20 | No fee |
| Original Application before the CAT | First listing within weeks; decision commonly one to three years | A fixed Rs 50 under Rule 7 of the CAT (Procedure) Rules, 1987, payable as the registry directs (confirm before filing), along with paper book and postage expenses |
| Implementation of the order | Usually within the time the order sets, often a few months | An execution or contempt application if it is not obeyed |
| Professional fee | Stage by stage | Settled at the first meeting and confirmed in writing |
Which forum hears an MACP case
For a clerk in a ministry, a trackman on the railways, a postman or a storekeeper in an ordnance depot, the MACP dispute is heard by the Central Administrative Tribunal, at the bench covering the present place of posting, or the home of a retired applicant. Railway staff have their own MACP orders issued through Railway Board letters, but the forum is the same. Our page on MACP not granted or withdrawn explains how the tribunal handles such cases.
A CRPF or BSF member also earns MACP, yet the tribunal is not open to him; he files a writ in the High Court, as our page for CAPF, PSU and bank employees explains. Soldiers, sailors and airmen below officer rank have a separate MACP of their own, and their forum is the Armed Forces Tribunal. Banks and PSUs generally run stagnation increments or their own promotion policies instead of MACP.
Where many employees of the same office are affected by the same error, a joint OA may be possible. If a decision in a colleague's case has already settled the point, ask the department in writing to extend it to you before filing; a refusal of that request is itself a fresh order you can challenge.
Bringing your MACP papers for a check
If you are looking for a service lawyer for an MACP case, or only want your own figures tested, collect the documents listed above, fill in a timeline sheet like the one on this page as far as you can, and bring or send copies. Advocate B.K. Singh and his team go through the papers in the order described here, tell you where the department's figures differ from yours and why, and advise whether a representation, an OA or no action at all is the sensible course. Consultations can be in person at the Dwarka or Vaishali offices or online from anywhere in India. For the general position on MACP claims, see our MACP upgradation page.

Frequently asked questions
How is MACP calculated for a central government employee?
First find the due date: the day you complete 10, 20 or 30 years of regular service from your entry grade, or 10 years in one level since your last move up. The upgrade takes you to the level immediately above in the matrix. For the pay, step one cell down your old level, then take the matching cell in the new level, or the first one higher.
How do I calculate MACP arrears?
For each period, subtract the basic pay you actually drew from the basic you would have drawn with MACP. Add dearness allowance on the difference at the rate for that period, and then house rent allowance and other basic-linked allowances. Do it month by month, because increments and DA rates change during the year.
What was the MACP grade pay under the 6th Pay Commission?
Under the 2009 scheme the upgradation was to the next grade pay in the hierarchy of pay bands, regardless of the promotional post's grade pay. For example, grade pay Rs 2,800 moved to Rs 4,200. Those grade pays now correspond to levels in the 7th CPC pay matrix.
Does the date of the screening committee decide when MACP starts?
No. MACP is due on the date you complete the required service, if you are found fit. A committee that meets late should grant it from the due date, with arrears, unless there was a valid reason to defer it.
Can I choose the date of next increment for MACP pay fixation?
Yes, the option available on promotion also applies to financial upgradations, generally within one month of the order. Compare both routes over a few years, because the route that gives less at first can give more later.
What documents do I need for an MACP dispute?
Your first regular appointment order, service book entries, all promotion and upgradation orders, APARs and disclosure letters, any penalty orders, pay fixation statements, pay slips around the due date, and copies of representations and replies. A dated timeline of these papers makes the dispute much easier to explain.
Do I need a service lawyer for an MACP case?
Not always. Many MACP errors are corrected on a clear representation with a correct calculation. Legal advice helps where the department has refused with reasons, where limitation is close, or where the dispute involves benchmarks, penalties or recovery.
Will I get interest on late MACP arrears?
Not automatically. Tribunals sometimes award interest where the department delayed without good reason for a long time. Ask for it in the representation and the OA, but expect the main relief to be the upgradation and arrears.
