Proving Your Vacancy Was Advertised Before 1 January 2004: Documents That Work

In short. OPS advertisement date proof is the document showing that the post you were selected for was advertised or notified before 22 December 2003, the date the 3 March 2023 OM uses. This guide is for central employees who joined on or after 1 January 2004 and whose old pension claim is stuck or refused for want of that proof. Gathering it usually takes one to four months; a Tribunal case, if needed, one to two years. Start with your offer of appointment letter and work backwards to the notice it names.

Is this your situation?

  • You joined a central post in 2004 or 2005 after an exam or interview held in 2003.
  • You opted for old pension in 2023, but the office says it cannot find the advertisement.
  • Your option was rejected because the notice date shown was after 22 December 2003.
  • Batchmates selected in the same exam got old pension and you did not.
  • The first notice for your post was cancelled and a fresh one issued later.
  • You were picked from a reserve panel or waiting list of a 2003 recruitment.
  • You have the appointment letter but nothing older than that.

In short

  • The date that matters is 22 December 2003, not 1 January 2004. The 3 March 2023 OM covers posts advertised or notified for recruitment before the date NPS was notified.
  • Your appointment letter is the best starting point. It usually names the notice number or the exam, which leads you to the notice itself.
  • The recruiting agency often has better records than your office. SSC, UPSC, RRBs and circle or regional recruitment cells keep notices and results longer than most sections do.
  • One batchmate's document can prove the date for everyone. An advertisement does not belong to one candidate.
  • A lost file in your office is not a reason to reject the claim. The department must search its own records and those of the recruiting agency before saying no.
  • Re-advertised posts are the hardest cases. Find out whether the later notice was a corrigendum to the old one or a fresh recruitment.

1 January 2004 or 22 December 2003: get the date right first

Most people speak of the 1 January 2004 line because that is when the National Pension System began for new central recruits. The 3 March 2023 OM of the Department of Pension and Pensioners' Welfare uses a slightly earlier date. It covers employees appointed against a post or vacancy advertised or notified for recruitment before 22 December 2003, the date on which NPS was notified. So if your notice appeared on 26 December 2003, this OM does not cover you, even though it was before 1 January 2004.

An earlier DoPPW order of 2020 dealt with a narrower group: those whose results were declared on or before 31 December 2003 but who joined on or after 1 January 2004. That order looked at the result date. The 2023 OM looks at the advertisement date and covers far more people. If your results came out in 2003, both may help you, and you should cite both.

Get your own date absolutely clear before you write to anyone. A claim letter that says 'advertised in 2003' invites the reply 'please furnish proof'. A letter that says 'advertised in Employment News dated 18 to 24 October 2003, notice number such-and-such, copy enclosed' moves the file.

What the 3 March 2023 OM actually asks you to prove

The OM asks one factual question: was the post or vacancy against which you were appointed advertised or notified for recruitment before 22 December 2003? It does not ask why you joined late. It does not ask whether the delay was the department's fault or yours. It does not ask when the exam was held or when results came out. The whole claim turns on the date of the advertisement or notification for the recruitment that led to your appointment.

Eligible employees had to exercise the option by 31 August 2023. The appointing authority was to examine each case and issue orders by 31 October 2023, and NPS accounts of those found eligible were to close from 31 December 2023. Many departments missed those dates, and many claims are still pending or under challenge in 2026. If yours was rejected or never decided, the proof question is usually the reason.

Note the word notified. For some posts, especially lower ones filled through employment exchanges or by circle and divisional offices, there was no newspaper advertisement at all. The vacancy was notified to the employment exchange or announced by a departmental circular. A dated requisition to the exchange or a dated circular inviting applications can serve as proof for such posts.

OPS advertisement date proof when the office says the file is lost

Recruitment files from 2003 have often been weeded out, shifted to a record room in another city, or lost in an office move. A section officer looking at your claim may find nothing and simply write that the advertisement is not available. That is the start of the search, not the end of it.

The department is the party that recruited you, and it is in a far better position than you to find its own notices. Write back pointing out that the recruitment file, the indent to the recruiting agency, the dossiers received from the agency and the appointment register all exist somewhere, and ask that each be searched. Ask them also to write to the recruiting agency. A rejection issued without these searches is weak, and tribunals have not been impressed by departments that claim to have lost their own records.

In parallel, look for proof yourself. File RTI applications with both the department and the recruiting agency, asking for a copy of the notice under which candidates for your post were recruited in that year. Name the exam or post, the year and your roll number if you have it. Our guide on using RTI to get service records has tips on wording such applications so they are not returned as vague.

Your own personal file and service book can also help. The first page of the service book sometimes records the mode of recruitment and the notice. The guide on getting a copy of your service book and personal file explains how to ask for them.

Advocate B.K. Singh's first tip: go to the recruiting agency, not only your office

Offices that employ you change their staff, their buildings and their filing systems many times in twenty years. Recruiting agencies tend to keep notices longer, because their notices are public documents and are cited in later disputes. Advocate B.K. Singh's suggestion is to write to the agency directly, as well as to your own department, and to do it at the same time rather than one after the other.

For SSC recruitments, that means the regional office that conducted the exam. For UPSC, the Commission's examination wing. For railway posts, the Railway Recruitment Board or Railway Recruitment Cell concerned. For posts filled by a postal circle, a defence command or a regional office, the cell that ran the recruitment. A short letter giving the post, the exam year and your roll number, asking for a certified copy of the notice and its date of publication, is often answered faster than an RTI.

If the agency confirms the date in writing, that letter alone can settle the claim. Departments find it hard to argue with the body that issued the notice.

Tricky cases: re-advertisement, corrigendum, reserve panels and backlog vacancies

Corrigendum or extension. If the original notice came out before 22 December 2003 and a later notice only extended the closing date or corrected a detail, the original date should govern. The later notice is part of the same recruitment. Keep both and show that the notice number stayed the same or that the later one refers to the earlier.

Cancelled and re-advertised. If the first recruitment was cancelled and a fresh notice issued after 22 December 2003, the claim is much harder, because the recruitment that led to your appointment began after the cut-off. Look closely at whether it was truly cancelled or merely postponed. A recruitment that continued with the same applicants, the same vacancies and an amended schedule is arguably the same process.

Reserve panel or waiting list. If you were appointed in 2005 from the reserve list of a recruitment advertised in 2003, the advertisement date is still 2003. The OM speaks of the post or vacancy against which you were appointed being advertised before the cut-off, and a reserve panel appointment flows from that same notice.

Backlog vacancies. If your post was a 2002 or 2003 vacancy but was advertised only in 2004, the OM does not help; it looks at the advertisement date, not the vacancy year. In such cases, look at whether any earlier notice covered the same vacancies.

Already in central service before 2004. If you held a central government post before 1 January 2004 and moved to another central post later through proper channel with technical resignation, your old pension may be protected under separate rules altogether. Do not rely on the advertisement route in that situation without checking the continuity provisions first.

Building the proof file, step by step

  1. Start with your appointment letter

Read the offer of appointment and the appointment order for any reference to an exam name, notice number or year. Note every number and date. This is the thread the rest of the search follows.

  2. Write to the recruiting agency and your department together

Send both a short letter asking for a certified copy of the notice and its publication date. Name the post, the exam year and your roll number. Keep proof of dispatch.

  3. File RTI applications if letters bring nothing

After about 30 days, file RTI applications with both offices asking for the notice, the indent and any list of candidates appointed from that recruitment. Use the first appeal if the reply is incomplete.

  4. Contact batchmates and the association

Ask batchmates selected in the same exam for any document they kept: admit card, Employment News page, offer letter quoting the notice. Ask whether any of them has already been granted OPS, and get a copy of that order.

  5. Put the papers in date order with a one-page chronology

List each document with its date and what it shows, ending with your joining date. A reader should see the notice date at the top of the page.

  6. Send a complete claim with the chronology

Submit the papers to the appointing authority with a covering letter citing the 3 March 2023 OM and asking for a decision within a stated time. If your option was already made in 2023, say so and attach that too.

If the department still refuses, or stays silent for six months, the proof file you have built becomes the core of an application to the Tribunal. Our page on old pension claims for pre-2004 vacancies explains how that case is presented.

What the finished proof file should contain

Primary proof of the date

  • Copy of the notice as published, with the page showing the date
  • Recruiting agency's letter or RTI reply confirming the notice and date
  • Employment exchange requisition or departmental circular, for locally filled posts

Link between you and that notice

  • Offer of appointment and appointment order
  • Admit card, roll number slip or interview call letter
  • Application acknowledgement or fee receipt
  • Result notice or select list showing your name

Supporting material

  • Orders granting old pension to batchmates from the same recruitment
  • Your 2023 option form and its acknowledgement
  • Any rejection letter and your reply
  • A short affidavit explaining the documents, if gaps remain

Who still needs this proof after the 2023 deadline

The option window under the 3 March 2023 OM closed on 31 August 2023. That does not make the proof question dead. Several groups still need it in 2026.

The largest group is employees who opted in time but whose claims were rejected or left pending because the department said it could not verify the advertisement. For them, proof is the whole case. A second group is employees who were never told about the OM, because their office did not circulate it, and who have since asked for the option to be accepted late; tribunals look at such claims case by case, and the employee's ability to prove eligibility is usually the first thing examined.

A third group is compassionate appointees. A DoPPW order of 22 June 2026 extends the old pension route to compassionate appointees whose applications were made on or before 31 December 2003. For them the proof is of the application date, not an advertisement; our guide on compassionate appointment and old pension covers that route.

If you have already opted and the department has accepted your eligibility, but you are still in NPS, the problem is implementation, not proof. That is dealt with in our guide on exercising the OPS option but staying in NPS.

Railway, postal, defence civilian and autonomous body staff

Railway employees recruited through Railway Recruitment Boards after a 2003 employment notice should look first for the RRB's employment notice number, which usually appears on the call letter. Railway staff should also check the Railway Board's own circular on the option, which applies to them in place of the DoPPW OM, and the Railway Services (Pension) Rules, 2026 for later stages.

Postal staff recruited as Postal Assistants, Sorting Assistants or Postmen in 2003 recruitments were often selected through circle or divisional notifications. These rarely appeared in national newspapers, so look for the circle's notification number in your appointment memo and ask the circle office for the original. Gramin Dak Sevaks who later joined departmental posts should check the date of the notice for the departmental post, not their GDS engagement.

Defence civilian staff, such as clerks, storekeepers and tradesmen in depots and units, were often recruited by local advertisement or through the employment exchange. The unit's recruitment board proceedings, if they survive, carry the dates. Command headquarters may hold copies when the unit does not.

Employees of autonomous bodies and societies should first check whether their organisation adopted the 3 March 2023 OM, because the OM was issued for central government civil employees. Where the body's own pension rules follow the CCS rules and it extended the OM, the same proof is needed. Whether CAT can hear such a case depends on whether the body has been notified under Section 14(2) of the Administrative Tribunals Act.

Time and cost of gathering proof and pursuing the claim

StageTypical timeCost
Letters to the recruiting agency and your departmentReplies in three to eight weeks, if they comePostage
RTI applications and first appealsOne to three months in allRs 10 per application to a central public authority; copying charges for pages supplied
Tracing a published notice through a library or archiveA few days to several weeks, depending on how precise your details areTravel and copying
Fresh claim to the appointing authorityDecision in one to six months, though many offices take longerNil
Original Application before CATOften one to two years; group OAs by a batch can move faster on common factsA small fixed filing fee (Rs 50 under Rule 7 of the CAT (Procedure) Rules; confirm the amount and mode with the registry) and the lawyer's fee, discussed at the first meeting and agreed in writing for each stage

Where a refused claim is taken

A central civil employee whose old pension claim is refused files an Original Application under Section 19 before the CAT bench for the area where he or she is posted, or where the cause of action arose. A batch of employees from the same recruitment can file one joint application if their facts and relief are the same, which keeps costs down and puts the common proof in one place.

The relief usually asked for is a direction to treat the applicant as eligible under the 3 March 2023 OM, to accept the option, and to issue the order bringing the applicant under the CCS (Pension) Rules. Where a batchmate has already been granted the benefit, the application points to that order and asks for equal treatment.

CAPF personnel recruited in 2004 or later after a 2003 notice go to the High Court, not CAT, and their old pension claims have their own history of litigation; see our page on service writs for CAPF, PSU and bank staff. PSU and bank employees are outside the 2023 OM altogether because their pensions are governed by their own regulations.

Time limits apply here as elsewhere. If your option was rejected by a written order, count a year from that order, or from six months after any representation you made against it. Pension status is in some ways a continuing matter, but do not count on that argument to excuse a late filing.

A made-up example: a Postal Assistant in Thrissur

Here's a made-up example. Anitha joined as a Postal Assistant in a Thrissur division in August 2004. She had applied in late 2003 for a circle-level direct recruitment and written the exam in January 2004. In June 2023 she opted for old pension. In December 2023 the division rejected her option in one line: 'notification date not available on record'.

Her appointment memo mentioned 'PA/SA Direct Recruitment 2003' and a circle office letter number. Her own papers included an admit card dated December 2003. A batchmate in another division had kept the circle notification, dated 10 November 2003, and had already been granted old pension by his division in 2024.

Anitha wrote to the circle office asking for a certified copy of the notification and filed an RTI with her division asking for the recruitment file. The circle office confirmed the notification and its date. She sent a fresh claim with the notification, the confirmation, her admit card, the batchmate's OPS order and a one-page chronology. If the division still refuses in a case like this, an application before the Ernakulam Bench of CAT would rest on documents the department itself issued, which is the strongest footing such a claim can have.

Mistakes that sink an otherwise good claim

Quoting the wrong date is the most common. Employees write that the post was advertised 'before 1 January 2004' and attach a notice dated 24 December 2003, not realising that the 3 March 2023 OM uses 22 December 2003. Check the date before you send anything.

The second is relying on the exam date or the result date. An exam held in January 2004 tells the department nothing about when the notice came out, and an exam held in 2003 suggests an earlier notice but does not prove its date. Find the notice.

The third is sending originals. Send self-attested copies and keep the originals for the Tribunal, where they may need to be shown. Old admit cards and newspaper pages cannot be replaced.

The fourth is going alone when a batch is affected. If thirty people were recruited under the same notice, the department's answer to one of them is likely to be its answer to all. A shared proof file and, if needed, a joint application are more efficient and harder to refuse. Our guide on collecting evidence for a service dispute has a broader checklist.

Start this week

Pull out your offer of appointment and appointment order and note every number and date in them. Write to the recruiting agency and to your department on the same day asking for a certified copy of the notice. Call two or three batchmates and ask what they kept.

Advocate B.K. Singh's second tip is to treat the advertisement as shared evidence. One batchmate's Employment News page, or one division's OPS order for the same recruitment, can carry the claims of everyone selected under that notice. Pool the papers early, before anyone files alone. For a closer look at how he prepares such files, see Advocate B.K. Singh on proving a pre-2004 advertisement, and for the Tribunal stage, our page on pre-2004 vacancy employees placed in NPS.

If your old pension claim is stuck for want of proof, ask Advocate B.K. Singh to review your papers or to tell you of any new DoPPW orders on the cut-off.

Frequently asked questions

Is the cut-off for old pension 1 January 2004 or 22 December 2003?

For the 3 March 2023 OM, the post must have been advertised or notified before 22 December 2003, the date NPS was notified. A notice published between 22 and 31 December 2003 is not covered by that OM, though an earlier 2020 order based on result dates may help some people.

My exam was in 2003. Is that enough proof?

It points in the right direction but does not prove the notice date. Use the admit card as supporting evidence and find the notice itself through the recruiting agency, your department or batchmates.

What if my department says the advertisement is not on record?

Ask it in writing to search the recruitment file, the indent to the agency and the appointment register, and to write to the recruiting agency. File RTI applications yourself at the same time. A refusal without a proper search can be challenged.

Can I use a batchmate's documents?

Yes. An advertisement covers everyone recruited under it, so a batchmate's copy of the notice, or an order granting him old pension under the same notice, is valid evidence for you too.

Does it matter that I joined late because of police verification?

Not under the 3 March 2023 OM. That OM looks only at whether the post was advertised or notified before 22 December 2003. The reason for late joining is not part of the test.

I was appointed from a waiting list in 2005. Am I covered?

If the recruitment that produced the waiting list was advertised before 22 December 2003, you have a good argument that you are. Gather the original notice and the order operating the waiting list.

The deadline of 31 August 2023 has passed. Is there any point now?

Yes, if you opted in time and your claim is pending or was rejected for want of proof. If you never opted because the OM was not circulated, a late claim is harder and is examined case by case.

Which documents should I never send in original?

Old admit cards, original newspaper pages and your appointment letter. Send self-attested copies and keep originals safe for inspection by the Tribunal if needed.
